Prior to that time, NIOC exported crude oil produced both from its onshore and offshore fields.
وقبل هذا الوقت، كانت الشركة الإيرانية تصدر نفطا خاما تنتجه حقولها البرية والبحرية على السواء.

Accordingly, the Panel recommends that no compensation be awarded for NIOC's claimed loss of profits from crude export sales.

In its statement of claim, NIOC converted the interim figures into United States dollars at exchange rates it selected.
وقامت الشركة الإيرانية في بيان مطالبتهـا بتحويل الأرقام المؤقتة إلى دولارات من دولارات الولايات المتحدة بأسعار صرف اختارتها بنفسها.

The Panel also notes that NIOC submitted one statement of claim in support of all of the claim forms, thus suggesting that the claimant intended this document to summarise its consolidated claim.
كذلك يلاحظ الفريق أن الشركة الإيرانية قدمت بيان مطالبة واحداً تدعيماً لجميع استمارات المطالبات، موحية بذلك أن الجهة المطالبة قصدت أن تكون هذه الوثيقة ملخصاًَ لمطالبتها الموحدة.

The Panel further notes that NIOC relied on the amounts set out in the statement of claim as the starting point in its responses to the Commission's claim investigation procedures.
ولاحظ الفريق أيضاً أن الشركة الإيرانية اعتمدت على المبالغ الواردة في بيان المطالبة كنقطة انطلاق في اجاباتها على اجراءات اللجنة الخاصة بالتحقيق في المطالبات.

In particular, NIOC alleged and offered to prove that losses suffered by certain of its divisions were substantially larger than those reflected in its amended claim.
وزعمت الشركة الإيرانية بشكل خاص أن الخسائر التي تكبدتها بعض من شُعبها كانت أكبر كثيراً من تلك الواردة في مطالبتها المعدلة، وعرضت إثبات ذلك.

Iraq first raises a procedural objection to NIOC's claim.
193- أثار العراق في البداية اعتراضا اجرائيا على مطالبة الشركة الإيرانية.

Iraq contends that NIOC earned extra profits exceeding its alleged losses due to the invasion-related increases in price and volume.
ويؤكد العراق أن الشركة الإيرانية حصلت على أرباح إضافية تتجاوز خسائرها المزعومة نظرا للزيادات في الأسعار والأحجام بسبب الغزو.

NIOC acknowledged that it had benefited from the increase in oil prices over the same period, but argued that these amounts should not be set off against its losses.
وتعترف الشركة الإيرانية بأنها استفادت من الزيادة في أسعار النفط على مدى هذه الفترة نفسها، ولكنها جادلت بأن هذه المبالغ لا تعوض خسائرها.

NIOC noted that the increased price benefited all oil producing countries, including countries outside the Middle East such as Nigeria and Venezuela.

In addition, Iraq contended that the losses claimed by NIOC are not compensable because they are not direct.
