15- أما سلب حريته حالياً، فهو نتيجة لحكم صادر من محكمة بلدية بلاثيتاس بتاريخ 13 تموز/يوليه 2013، بعد محاكمةٍ استوفت جميع الضمانات القانونية والإجرائية والتزم فيها القاضي بضمان حضور المتهم شخصياً في جميع مراحل الدعوى.

8. Urges States not to expel, return (refouler), extradite or in any other way transfer a person to another State where there are substantial grounds for believing that the person would be in danger of being subjected to torture, and stresses the importance of effective legal and procedural safeguards in this regard;
8- يحث الدول على عدم طـرد أي شخص أو إعادته (إعادة قسرية) أو تسليمه أو نقله بأي طريقة أخرى إلى دولـة أخرى حيث توجد أسباب حقيقيـة تدعـو إلى الاعتقاد بأن هذا الشخص سيكون عرضة لخطر التعذيب، وتشدد على أهمية الضمانات القانونية والإجرائية الفعالة في هذا الصدد؛

60. 60- يحث قرار المجلس 13/19 الدول على " عدم طـرد أي شخص أو إعادته (إعادة قسرية) أو تسليمه أو نقله بأي طريقة أخرى إلى دولـة أخرى حيث توجد أسباب حقيقيـة تدعـو إلى الاعتقاد بأن هذا الشخص سيكون عرضة لخطر التعذيب، ويشدد على أهمية الضمانات القانونية والإجرائية الفعالة في هذا الصدد " ().

Failure to observe the legal and procedural guarantees for pretrial detainees is a serious challenge to respect for human rights in prisons.
ويمثِّل عدم مراعاة الضمانات القانونية والإجرائية الواجب تقديمها إلى المحتجزين على ذمة المحاكمة تحدياً خطيراً في مجال احترام حقوق الإنسان في السجن.

(a) Review legislation and policy of depriving persons with mental disabilities of their legal capacity, provide legal and procedural safeguards for their rights and ensure that they have prompt access to effective judicial review of decisions, as well as effective remedy against violations;

5. Stresses that effective legal and procedural safeguards for the prevention of torture and other cruel, inhuman or degrading treatment or punishment include, inter alia, ensuring that any individual arrested or detained is brought promptly before a judge or other independent judicial officer in person, and permitting prompt and regular medical care and legal counsel as well as visits by family members;
5- يشدد على أن من الضمانات القانونية والإجرائية الفعالة لمنع التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، ضمان المثول الفوري والشخصي لأي فرد معتقل أو محتجز أمام قاض أو موظف قضائي مستقل آخــر، والسماح له بالحصول بسرعة وانتظام على الرعاية الطبية والمشورة القانونية وكذا زيارة أقاربه له؛

It must only be exercised when there are no other alternatives, and be undertaken for legitimate purposes with sufficient legal and procedural guarantees.
ويجب ألا يتم اللجوء إليه إلا عند عدم توافر أي بدائل أخرى، وينبغي الاضطلاع به لأغراض مشروعة مع تأمين ما يكفي من الضمانات القانونية والإجرائية().
