وتنصُّ تلك الفقرة أيضاً على ألاَّ يمسَّ اشتراط توجيه الطلبات إلى السلطات المركزية المعيَّنة بحق الدولة الطرف في أن تشترط توجيه الطلبات والمراسلات عن طريق القنوات الدبلوماسية.

This requirement shall be without prejudice to the right of a State Party to require that such requests and communications be addressed to it through diplomatic channels and, in urgent circumstances, where the States Parties agree, through the International Criminal Police Organization, if possible.
ولا يمس هذا الشرط حق أية دولة طرف في أن تشترط توجيه مثل هذه الطلبات والمراسلات إليها عبر القنوات الدبلوماسية، وفي الحالات العاجلة، وحيثما تتفق الدولتان الطرفان المعنيتان، عن طريق المنظمة الدولية للشرطة الجنائية، إن أمكن ذلك.

وعلى الرغم من أنَّ تلك الدولة تتيح إمكانية توجيه طلبات المساعدة القانونية المتبادلة وأيّ مراسلات متعلقة بها مباشرة إلى السلطة المركزية التي تعيّنها الدول الأطراف، فأنها تتيح أيضاً إمكانية إرسال تلك الطلبات والمراسلات عن طريق القنوات الدبلوماسية.

ولا يمس هذا الشرط بحق الطرف في اشتراط أن توجه تلك الطلبات والمراسلات اليه عبر القنوات الدبلوماسية .[أيدت عدة وفود نقل هذه الفقرة الى هذه المادة من مادة منفصلة كانت قد وردت في الوثيقة A/AC.254/4 .
