4. Where the electronic reverse auction has been preceded by an examination or evaluation of initial bids, the procuring entity shall promptly after the completion of the examination or evaluation of initial bids:

Some ERAs may be very simple, not even requiring the bidders' qualifications and responsiveness to be ascertained before the auction, while other may be more complex and involve prequalification, examination and evaluation of initial bids.
وقد تتسم بعض المناقصات بطابع بسيط جدا ولا تنطوي حتى على القيام قبل إجرائها، بالتحقق من مؤهّلات مقدِّمي العطاءات ومدى استجابتهم للمتطلبات، في حين قد تتسم أخرى بطابع أعقد وتنطوي على الإثبات المسبق لأهلية العطاءات الأولية وفحصها وتقييمها.

In such cases, the procuring entity must both request initial bids and provide sufficiently detailed instructions for preparing them, including the scope of the initial bids, the language in which they are to be prepared and the manner, place and deadline for presenting them.
وعليها في هذه الحالات أن تطلب تقديم عطاءات أولية وأن توفّر تعليمات مفصّلة بما فيه الكفاية عن إعداد هذه العطاءات، بما يشمل نطاق العطاءات الأولية واللغة المقرّر إعدادها بها وطريقة تقديمها ومكان وموعد تقديمها النهائي.

18. Paragraph (4) regulates additional pre-auction steps that are required for an examination or evaluation of initial bids.
18- وتنظّم الفقرة (4) خطوات إضافية تسبق المناقصة وهي ضرورية لفحص العطاءات الأولية أو تقييمها.

20. As stated in paragraph 2 above, some complex auctions may involve an examination and all initial bids that meet the minimum threshold are admitted to the auction.
20- ومثلما ذُكِر في الفقرة 2 أعلاه، فقد تنطوي بعض المناقصات المعقدة على فحص العطاءات الأولية ويُقبل جميع المستوفي منها للعتبة الدنيا في المناقصة.

1. The procurement regulations should assist the procuring entity in the assessment of the circumstances that would necessitate the pre-auction ascertainment of qualifications of bidders or examination and/or evaluation of initial bids.

The procurement regulations may usefully emphasize that holding the discussions is an option, not an obligation: the procuring entity may be able to refine and finalize the terms and conditions of the procurement without holding the discussion, on the basis of the initial tenders received.
وقد يكون من المفيد أن تؤكد لوائح الاشتراء على أنَّ إجراء المناقشة أمرٌ اختياري وليس التزاما: قد تكون الجهة المشترية قادرة على تنقيح أحكام الاشتراء وشروطه ووضعها في صيغتها النهائية دون عقد المناقشة، وذلك استناداً إلى العطاءات الأولية المتلقّاة.

They in particular may list grounds for rejection of initial tenders, drawing on the list in article 43 (2) of the Model Law [**hyperlink**] as appropriate (noting that the grounds touching upon prices of the tenders would not be applicable since initial tenders do not include price).
ويجوز لها بصورة خاصة أن تدرج أسباب رفض العطاءات الأولية استنادا إلى القائمة الواردة في المادة 43 (2) من القانون النموذجي [**وصلة تشعُّبية**] حسب الاقتضاء (مع ملاحظة أن الأسباب التي تمس أسعار العطاءات لن تنطبق نظرا لأن العطاءات الأولية لا تتضمن أسعارا).

4. The procurement regulations should explain the purpose for and nature of the discussion held in this procurement method, in particular that discussion does not involve binding negotiations or bargaining of any type and may concern any aspect of initial tenders that were not rejected but price.
4- وينبغي أن توضح لوائح الاشتراء الغرض من المناقشة التي تُعقد في طريقة الاشتراء هذه وطبيعتها، وخصوصا من حيث إنَّ المناقشة لا تنطوي على مفاوضات ملزِمة أو مساومة من أي نوع، وقد تتعلق بأي جانب من جوانب العطاءات الأولية التي لم تُرفض عدا السعر.
