303- تطالب شركة صناعة الكيماويات البترولية بتعويض قدره 758 147 24 ديناراً كويتياً عن الخسائر والأضرار التي لحقت بممتلكاتها العقارية والمادية.

In view of the inconsistent application of the distinctions, overlaps between the different categories and the artificial nature of the separation of the losses, the Panel elected to assess PIC's real and tangible property losses under the categories appearing in the following table.

In the First " F3 " Report, the " F3 " Panel recommended that compensation be awarded to PAYS in respect of its claims for losses of real and tangible property.

With regard to compensable real and tangible property losses, the Panel satisfied itself as to the existence of the property and the Claimant's title thereto at the time of the loss, the fact of loss and whether the loss was caused by Iraq's invasion and occupation of Kuwait.

79- وفيما يتعلق بمطالبات التعويض عما لحق بالممتلكات العقارية والمادية من أضرار نتيجة للعمليات العسكرية التي جرت في الخفجة بالمنطقة الشرقية نتيجة للهجمات بصواريخ سكود، يقرر الفريق أن تاريخ الخسارة هو 7 شباط/فبراير 1991(44).

Al-Nasr Sports Club has also sought compensation for losses of real and tangible property. (See paragraphs 44-45 below in respect of the claimant's claim for loss of tangible property.) The claimant's claim for loss of real property relates to repairs to or replacement of certain of its facilities.
34- وقدم نادي النصر الرياضي أيضاً مطالبة يلتمس فيها التعويض عن خسائر في الممتلكات العقارية والمادية. (انظر الفقرتين 44 و45 أدناه بشأن مطالبة النادي بالتعويض عن الخسائر في الممتلكات العقارية والمادية). وتتعلق هذه المطالبة بإصلاح أو استبدال بعض مرافق النادي.

With respect to claims for real and tangible property damage occurring as a result of the invasion of Al Khafji, military operations in the Eastern Province and as a result of scud missile attacks, the Panel determined that the date of loss is 7 February 1991. /
31- وقرر الفريق، فيما يتعلق بالمطالبات المتصلة بخسائر الممتلكات العقارية والمادية المتكبدة نتيجة لغزو مدينة الخفجي والعمليات العسكرية في المنطقة الشرقية ونتيجة الهجمات بقذائف " سكد " ، أن تاريخ الخسارة هو 7 شباط/فبراير 1991(31).

The Panel finds that Saudi Arabian Government claims for real and tangible property damage suffered as a result of Iraq's Scud missile attacks on Saudi Arabia, the battle of Al Khafji and other military operations in Saudi Arabia are, in principle, compensable in accordance with paragraph 34(a) of Governing Council decision 7, subject to consideration of the applicability of Governing Council decision 19.
37- ويرى الفريق أن مطالبات حكومة المملكة العربية السعودية بالتعويض عن الأضرار اللاحقة بالممتلكات العقارية والمادية نتيجة لهجمات العراق بصواريخ سكود على المملكة العربية السعودية ومعركة الخفجي وغيرها من العمليات العسكرية في المملكة العربية السعودية هي، من حيث المبدأ، قابلة للتعويض وفقاً للفقرة 34(أ) من مقرر مجلس الإدارة 7 رهناً بالنظر في قابلية تطبيق مقرر مجلس الإدارة 19.

With respect to claims for real and tangible property damage occurring as a result of military operations in Al Khafji, the Eastern Province and as a result of Scud missile attacks, the Panel determines that the rate as of 7 February 1991, namely SAR 3.745:USD 1 is the most appropriate rate to convert amounts awarded in Saudi Arabian riyals to United States dollars.
82- وفيما يتعلق بمطالبات التعويض عما لحق بالممتلكات العقارية والمادية من أضرار نتيجة للعمليات العسكرية التي جرت في الخفجة بالمنطقة الشرقية ونتيجة للهجمات بصواريخ سكود، يقرر الفريق أن سعر الصرف الساري في 7 شباط/فبراير 1991، وهو 3.745 ريال سعودي لكل دولار من دولارات الولايات المتحدة، هو أنسب سعر صرف من أجل تحويل مبالغ التعويضات المدفوعة بالريالات السعودية إلى دولارات الولايات المتحدة.

Some of the Claims include claims for losses, including real and tangible property damage, that the Claimants allege arose as the result of military operations, including ground, air and Scud missile attacks by Iraq against Saudi Arabia during the period of Iraq's invasion and occupation of Kuwait.
