٢٧٦ - يعرب عن قلق شديد إزاء غياب أحكام تشريعية تصنف نشر اﻷفكار، التي تقوم على التفوق العنصري أو الكراهية العنصرية وأعمال العنف أو التحريض على العنف ضد أي عرق أو أي جماعة من اﻷشخاص من لون أو أصل إثني آخر، وتقديم المساعدة للنشاطات العنصرية، جريمة يعاقب عليها القانون، وفق ما تقضي به المادة ٤.

(a) To declare an offence punishable by law all dissemination of ideas aimed at discrimination or hatred, as well as all acts of violence or incitement to such acts against any particular group of persons;
(أ) إعلان أن جميع أشكال نشر الأفكار الرامية إلى التمييز أو الكراهية، وكذلك جميغ أعمال العنف أو التحريض على هذه الأعمال ضد أي مجموعة معينة من الأشخاص، نعد جريمة يعاقب عليها القانون؛

15. The Special Rapporteur strongly condemns all acts of violence, or incitement thereto, against individuals based on religion or belief and calls upon States to take all necessary and appropriate measures to investigate these acts, prosecute and sanction the perpetrators in accordance with international human rights law, and compensate the victims.
15- يدين المقرر الخاص بشدة جميع أعمال العنف أو التحريض على هذه الأعمال التي ترتكب في حق أفراد بسبب دينهم أو معتقدهم ويدعو الدول إلى اتخاذ كل ما يلزم من تدابير مناسبة للتحقيق في تلك الأعمال ومقاضاة مرتكبيها ومعاقبتهم طبقا للقانون الدولي لحقوق الإنسان وتعويض الضحايا.

4. To declare an offence punishable by law all acts of violence or incitement to such acts against persons or groups of persons because of their race, colour, descent or national or ethnic origin;
4- إعلان جميع أفعال العنف أو التحريض على هذه الأفعال ضد شخص أو جماعة بسبب العنصر أو اللون أو النسب أو الأصل القومي أو العرقي جريمة يعاقب عليها القانون؛

Any advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence should be prohibited by law, as should the dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination as well as all acts of violence or incitement to such acts.
وينبغي أن يحظر القانون أي دعوة إلى الكراهية الوطنية أو العرقية أو الدينية تشكل تحريضا على التمييز أو العـداء أو العنف، وأن يحظر كذلك نشر الأفكار القائمة على التفوق العرقي أو الكراهية العرقية أو التحريض على التمييز العنصري، وجميع أعمال العنف أو التحريض على ارتكاب هذه الأعمال.

39. Any act of violence or incitement against a person or group on the grounds of race, colour, descent or national or racial origin is an offence punishable by the law.
39 - وجميع أفعال العنف أو التحريض ضد شخص أو جماعة بسبب العنصر أو اللون أو النسب أو الأصل القومي أو العرقي تشكل جريمة يعاقب عليها القانون.

He recalls that any advocacy of national, racial or religious hatred which constitutes incitement to discrimination, hostility or violence should be prohibited by law, as should the dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination as well as all acts of violence or incitement to such acts.

The Committee regrets the paucity of information as to article 4 of the Convention and notes with concern the lack of legislative provisions punishing the dissemination of ideas based on racial superiority or hatred, as well as acts of violence or incitement to violence and the organizations promoting racial discrimination, as required under article 4 of the Convention.
