13. The Court must furthermore satisfy itself that the advisory opinion requested does indeed relate to a " legal question " within the meaning of its Statute and the United Nations Charter.

15. On 1 February 2012, the Court delivered its advisory opinion concerning Judgment No. 2867 of the Administrative Tribunal of the International Labour Organization upon a complaint filed against the International Fund for Agricultural Development, in which it found that it had jurisdiction to give the advisory opinion requested and decided to comply with the request for an advisory opinion.
15 - وفي 1 شباط/فبراير 2012، أصدرت المحكمة فتوى تتعلق بالحكم رقم 2867 الصادر عن المحكمة الإدارية لمنظمة العمل الدولية بناء على شكوى مقدمة ضد الصندوق الدولي للتنمية الزراعية، قضت فيها بأن لها اختصاص إصدار الفتوى المطلوبة وقررت قبول طلب إصدار الفتوى.

In the case concerning Legality of the Use by a State of Nuclear Weapons in Armed Conflict, the Court found, by 11 votes to 3, that it was not able to give the advisory opinion requested because the request for such an opinion submitted by WHO did not relate to a question which arose “within the scope of (the) activities” of that organization.
وفي القضية الخاصة ﺑ " مدى قانونية استخدام دولة ما لﻷسلحة النوويــة فــي نــزاع مســلح " ، تبين للمحكمة، بأغلبية ١١ صوتا مقابل ٣ أصوات، أنه لا يمكنها أن تصدر الفتوى المطلوبة نظرا ﻷن الطلب المتعلق بتقديم هذه الفتــوى، والــذي عرضــته منظــمة الصحة العالمية، لا يتصــل بمســألة " تدخــل في نطــاق أنشطة " هذه المنظمة.

The requested opinion, it has been alleged, could complicate the negotiations envisaged in the " Roadmap " , and the Court should therefore exercise its discretion and decline to reply to the question put.
وقد دفع بأن الفتوى المطلوبة قد تعقد المفاوضات المنصوص عليها في " خريطة الطريق " ، وبأنه ينبغي للمحكمة بالتالي أن تمارس سلطتها التقديرية وأن تمتنع عن الرد على السؤال المطروح.

There is therefore in the present case no lack of information such as to constitute a compelling reason for the Court to decline to give the requested opinion.
وبالتالي لا يوجد في الحالة المعروضة نقص في المعلومات يمكن اعتباره من الأسباب القاهرة التي تحمل المحكمة على الامتناع عن إصدار الفتوى المطلوبة.

The Court has to respect Israel's choice not to address the merits, but it is the Court's own responsibility to assess whether the available information is sufficient to enable it to give the requested opinion.
إن على المحكمة أن تحترم اختيار إسرائيل بألا تتناول إسرائيل الأسباب الوجيهة للدعوى، لكن من مسؤولية المحكمة أن تقدر ما إذا كانت المعلومات المتاحة تكفي لتمكين المحكمة من إصدار الفتوى المطلوبة.

The fact that the question put to the Court does not relate to a specific dispute should consequently not lead the Court to decline to give the opinion requested.
وبالتالي فـإن كــون المسألة المعروضة على المحكمة لا تتصل بنزاع محدد لا يجب أن يحمل المحكمة على الامتناع عن إعطاء الفتوى المطلوبة.

15. Most of the reasons adduced in these proceedings in order to persuade the Court that in the exercise of its discretionary power it should decline to render the opinion requested by General Assembly resolution 49/75 K were summarized in the following statement by one State in the written proceedings:
١٥ - ولُخﱢص معظم اﻷسباب المسوقة في هذه المرافعات ﻹقناع المحكمة بأن تمتنع، في ممارستها لسلطتها التقديرية، عن إصدار الفتوى المطلوبة في قرار الجمعية العامة ٤٩/٧٥ كاف في البيان التالي الذي قدمته إحدى الدول في المرافعات الخطية:

68. Article 65 of the Statute of the International Court of Justice had always been interpreted as conferring discretion upon the Court whether to give the opinion requested, but the Court, like its predecessor, had always considered that there must be compelling reasons for it to exercise its discretion not to render an advisory opinion.
68 - وتفسَّر المادة 65 من النظام الداخلي لمحكمة العدل الدولية دائما بأنها تترك لتقدير المحكمة إصدار الفتوى المطلوبة أو عدم إصدارها، ولكن المحكمة ترى دوماً، كسابقتها، أنه لا بد من وجود أسباب قاهرة لديها تجعلها تقرر عدم إصدار الفتوى.

A careful reading of the judgment of the ICTFY (Trial Chamber) of 26 February 2009 discloses facts, determined by it, which appear to me of relevance to the ICJ for the purposes of the requested Advisory Opinion.
ومن شأن قراءة دقيقة لحكم المحكمة الجنائية الدولية ليوغوسلافيا السابقة (الدائرة الابتدائية)، بتاريخ 26 شباط/فبراير 2009، أن تكشف عن حقائق قررتها المحكمة وتبدو بالنسبة لي ذات أهمية بالنسبة لمحكمة العدل الدولية لأغراض الفتوى المطلوبة.

My conclusion on this point is that it is not at all for the Court to act " discretionally " ; the Court has to perform its advisory function, and ought to deliver, as it has just done, the requested Advisory Opinion, thus fulfilling faithfully its duties as the principal judicial organ of the United Nations.
والنتيجة التي أخلص إليها بشأن هذه النقطة هي أنه ليس للمحكمة على الإطلاق أن تتصرف على أساس " احتراز تقديري " فالمحكمة يتعين عليها أن تنهض بوظيفتها في الإفتاء، وينبغي لها أن تقدم، على نحو ما قدمت بالفعل، الفتوى المطلوبة. وبهذا تكون قد نهضت بكل أمانة بواجباتها بوصفها الجهاز القضائي الرئيسي للأمم المتحدة.

Similarly, in the Advisory Opinion on Legal Consequences of the Construction of a Wall in the Occupied Palestinian Territory, the Court commented that " [t]he Court cannot substitute its assessment of the usefulness of the opinion requested for that of the organ that seeks such opinion, namely the General Assembly " (I.C.J. Reports 2004 (I), p. 163, para. 62).
وعلى غرار ذلك، ذكرت المحكمة في الفتوى بشأن الآثار القانونية الناشئة عن تشييد جدار في الأرض الفلسطينية المحتلة أن ' ' لا يمكن للمحكمة أن تضع تقييمها لمدى فائدة الفتوى المطلوبة مكان تقييم الهيئة الطالبة لتلك الفتوى، أي الجمعية العامة`` (I.C.J. Reports 2004 (I), p. 163, Para. 62).
