Coherence has thus been achieved between the provisions of chapter III of Part two and article 30 in part one of the draft articles.
وهكذا يتحقق نوع من الترابط بين أحكام الفصل الثالث من الباب الثاني والمادة ٣٠ من الباب اﻷول لمشروع المواد.

The second is chapter III of Part Two which contains the rules on serious breaches of obligations under peremptory norms of general international law.

In some respects, however, the draft provisions contained in chapter III of Part two establishing substantive as well as procedural safeguards against unjustified or abusive countermeasures would seem to tip the balance in favour of the State that has committed the wrongful act.

The Nordic countries therefore continue to support the distinction also in the context of State responsibility and we agree with the solution now presented in chapter III of Part Two.

56 - وذكر أنه ينبغي الإبقاء على الفصل الثالث من الباب الثاني من مشروع المواد، وهو الفصل المتعلق بالإخلالات الجسيمة بالتزامات أساسية تجاه المجتمع الدولي. على أنه أضاف أن من الضروري زيادة إحكام صياغة هذا الفصل وما يتصل به من مواد.

30. With regard to countermeasures, the Commission had concluded that all of the articles in chapter III of Part two should apply without exception or modification to international crimes, attaching particular importance to the application of the provisions of articles 48, 49 and 50 to crimes.

His delegation had noted the various points of view expressed regarding serious breaches of obligations to the international community as a whole, and agreed that chapter III of Part Two should be retained and that the clear emphasis should be on peremptory norms as reaffirmed in the 1969 Vienna Convention on the Law of Treaties.

94. There was some support for replacing chapter III of Part Two and draft article 54, paragraph 2, with a saving clause to the effect that the draft articles were without prejudice to any regime that might be established to deal with serious breaches of obligations erga omnes.
