The Committee calls upon the State party to cover in its legislation all aspects of article 4 by ensuring that the dissemination of ideas based on racial superiority or hatred as well as organizations which promote and incite racial discrimination are prohibited.

وتطبق العقوبات على ترويج الأفكار القائمة على التفوق العرقي أو الكراهية والتحريض على التمييز العنصري في حدود التوافق مع حقوق حرية التجمع وتكوين الجمعيات والتعبير.

In this connection, the Committee also draws the attention of the State party to its general recommendation VII and general recommendation XV, affirming the compatibility of the prohibition of the dissemination of ideas based upon racial superiority or hatred with the right to freedom of opinion and expression.

As a result, propaganda of ideas based on racial superiority or hatred may only be punished if it results in criminal conduct such as physical violence, threat or defamation of an individual.

8. Encourages States to use the opportunities provided by new technologies, including the Internet, to counter the dissemination of ideas based on racial superiority or hatred;

Any advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence should be prohibited by law, as should the dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination as well as all acts of violence or incitement to such acts.
وينبغي أن يحظر القانون أي دعوة إلى الكراهية الوطنية أو العرقية أو الدينية تشكل تحريضا على التمييز أو العـداء أو العنف، وأن يحظر كذلك نشر الأفكار القائمة على التفوق العرقي أو الكراهية العرقية أو التحريض على التمييز العنصري، وجميع أعمال العنف أو التحريض على ارتكاب هذه الأعمال.

The Committee recommends that the State party revise its Criminal Code in order to introduce and implement a specific provision in full compliance with article 4 of the Convention that prohibits dissemination of ideas based on racial superiority or hatred, incitement of racial hatred and discrimination, and prohibition of organizations which promote and incite racial discrimination.
توصي اللجنة الدولة الطرف بأن تراجع قانون العقوبات على نحو تستحدث معه وتنفذ حكماً محدداً، يتوافق كلياً مع المادة 4 من الاتفاقية، ويحظر نشر الأفكار القائمة على التفوق العرقي أو الكراهية العرقية، والتحريض على الكراهية العنصرية والتمييز العنصري، ويحظر المنظمات التي تشجع التمييز العنصري وتحرض عليه.

He recalls that any advocacy of national, racial or religious hatred which constitutes incitement to discrimination, hostility or violence should be prohibited by law, as should the dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination as well as all acts of violence or incitement to such acts.

(c) To declare as an offence punishable by law all dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination, as well as all acts of violence or incitement to such acts against any race or group of persons of another colour or ethnic origin, and also the provision of any assistance to racist activities, including the financing thereof;
(ج) اعتبار كل نشر للأفكار القائمة على التفوق العرقي أو الكراهية العنصرية، وكل تحريض على التمييز العنصري، وكل عمل من أعمال العنف أو التحريض على مثل هذه الأعمال يرتكب ضد أي عرق أو أية جماعة من لون أو أصل عرقي آخر ، وكذلك توفير أي مساعدة لأنشطة عنصرية، بما في ذلك تمويلها، جرائم يعاقب عليها القانون؛

In view of the above, democratic rights and freedoms cannot justifiably be invoked to protect dissemination of ideas based on racial superiority or hatred since these ideas engender harm and negatively impact on the human rights and freedoms of the individuals or groups against whom they are directed.
17- وبالنظر إلى ما تقدم أعلاه، لا يمكن تبرير الاستناد إلى الحقوق والحريات الديمقراطية لحماية نشر الأفكار القائمة على التفوق العرقي أو الكراهية، بما أن هذه الأفكار تولّد أثراً ضاراً وسلبياً على حقوق الإنسان وحريات الأفراد أو الجماعات التي توجه ضدهم.

The Committee regrets the paucity of information as to article 4 of the Convention and notes with concern the lack of legislative provisions punishing the dissemination of ideas based on racial superiority or hatred, as well as acts of violence or incitement to violence and the organizations promoting racial discrimination, as required under article 4 of the Convention.

51. Like his predecessor, the Special Rapporteur encourages States to fully exploit the opportunities provided by new technologies, including the Internet, to counter the dissemination of ideas based on racial superiority or hatred (A/HRC/20/38, para. 12).

35. Encourages States to use all opportunities, including those provided by the Internet and social media, to counter the dissemination of ideas based on racial superiority or hatred and to promote the values of equality, non-discrimination, diversity and democracy;

31. In addition, article 4 of the International Convention on the Elimination of All Forms of Racial Discrimination stipulates that States parties shall declare all dissemination of ideas based on racial superiority or hatred and incitement to racial discrimination an offence punishable by law.

(a) Shall declare an offence punishable by law all dissemination of ideas based on racial superiority or hatred, and incitement to racial discrimination, as well as all acts of violence or incitement to such acts against any race or group of persons of another colour or ethnic origin, and also the provision of any assistance to racist activities, including the financing thereof;
(أ) اعتبار كل نشر للأفكار القائمة على التفوق العرقي أو الكراهية العرقية والتحريض على التمييز العنصري وجميع أعمال العنف أو التحريض على ارتكاب هذه الأعمال ضد أي عرق أو أية مجموعة أشخاص من لون أو أصل عرقي آخر وتوفير أي مساعدة لأنشطة ذات طابع عنصري، بما في ذلك تمويلها، جريمة يعاقب عليها القانون؛

In this connection, the Committee also draws the attention of the State party to its general recommendations VII and XV on the compatibility of the prohibition of the dissemination of ideas based upon racial superiority or hatred with the right to freedom of opinion and expression.
وفي هذا الصدد، تسترعي اللجنة أيضاً اهتمام الدولة الطرف إلى توصيتيها العامتين السابعة والخامسة عشرة بشأن توافق حظر نشر الأفكار القائمة على التفوق العرقي أو الكراهية العرقية مع الحق في حرية الرأي والتعبير.

The Committee recalled that article 4 of the Convention requires States parties to penalize four categories of misconduct: (i) dissemination of ideas based upon racial superiority or hatred; (ii) incitement to racial hatred; (iii) acts of violence against any race or group of persons of another colour or ethnic origin; and (iv) incitement to such acts.
وذكَّرت اللجنة بأن المادة 4 من الاتفاقية تطالب الدول الأطراف بتجريم أربع فئات من فئات سوء السلوك هي: `1` بث الأفكار القائمة على التفوق العرقي أو الكراهية؛ `2` التحريض على الكراهية العرقية؛ `3` أعمال العنف ضد أي عرق أو أية جماعة من الأشخاص من لون أو أصـل إثني آخر؛ `4` التحريض على مثل هذه الأعمال.
