While noting that the existing penal legislation is undergoing reform, the Committee is nevertheless concerned that article 69 of the Penal Code currently in force does not prohibit all dissemination of ideas based on racial superiority and incitement to racial discrimination as required by article 4 of the Convention.

The International Convention on the Elimination of All Forms of Racial Discrimination, for example, directly addresses the " dissemination of ideas based on racial superiority or hatred " , and thus implicates Internetbased racist content.

49. Encourages States to promote the opportunities provided by the Internet and social media to counter the dissemination of ideas based on racial superiority or hatred and to promote equality, non-discrimination and respect for diversity;

In this regard the Special Rapporteur strongly encourages States to use the opportunities provided by the Internet to counter the dissemination of ideas based on racial superiority or hatred; promote equality, non-discrimination and diversity; improve mutual understanding; and build a culture of peace.

In order to implement the General Assembly resolution, the following acts would be considered to be offences: the dissemination or propagation of ideas based on racial superiority; acts of violence and incitement to racial discrimination; any gross and flagrant violation of or limitation on freedom of opinion and expression and freedom of association and assembly; and defamation of a race or ethnic group.

For this reason, application of the principle of expediency to the " dissemination of ideas based on racial superiority or hatred " does not contradict General Recommendation 15.
