قانونُ الدولة التي ذُكر صراحة في اتفاق الحساب أنها الدولة التي يحكم قانونها ذلك الاتفاق، أو قانونٌ آخر إذا كان اتفاق الحساب ينص صراحة على انطباق ذلك القانون الآخر على جميع تلك المسائل.

Article 3 In this and any other law, the following words and expressions shall have the meanings stated beside each unless context requires otherwise or a different meaning or interpretation is stipulated in the other law:
في هذا القانون، وفي أي قانون آخر، تكون للكلمات والتعبيرات التالية المعاني المبينة أمام كل منها ما لم يقتض سياق النص معنى آخر أو ما لم ينص على معنى أو تفسير مغاير في ذلك القانون الآخر:

We give him the right to ignore another law, and another, finally to condone the taking of a human life.

If, under that other law, there is a security right in types of proceeds to which the law applies, the law applies to that security right except to the extent that that other law applies to [the third-party effectiveness, priority or enforcement of that security right] [that security right].
فإذا كان هناك، بموجب ذلك القانون الآخر، حق ضماني في أنواع العائدات التي ينطبق عليها هذا القانون، ينطبق هذا القانون على ذلك الحق الضماني ماعدا بقدر انطباق ذلك القانون الآخر على [نفاذ ذلك الحق الضماني أو أولويته أو إنفاذه، تجاه الأطراف الثالثة] [ذلك الحق الضماني].

But I did hear this other law.

The Constitution is the highest law of the land, and, as a consequence, if any other law is inconsistent with the Constitution, the Constitution prevails and the other law is, to the extent of its inconsistency, void (Section 6, Constitution of Malta).
والدستور أرفع قانون في البلد، وبالتالي، إذا تعارض أي قانون آخر مع الدستور يتغلب الدستور ويصبح القانون الآخر لاغيا فيما يتعلق بهذا التعارض. (القسم 6 من دستور مالطة).

The Constitution of Kenya, 2010 was promulgated on 27th August 2010 as the supreme law of the Republic of Kenya and is applicable country wide and if any other law is inconsistent with the Constitution, then the Constitution shall prevail and the other law is, to the extent of the inconsistency, void.
53- صدر الدستور الكيني لعام 2010 في 27 آب/أغسطس 2010 بوصفه القانون الأعلى لجمهورية كينيا، ويطبق في جميع أنحاء البلد وإذا تعارض أي قانون آخر مع الدستور، فإن الدستور يسري ويلغى الجزء المتعارض من القانون الآخر.

One view was that those matters should be subject to the law governing the bank account agreement or other law provided in the account agreement, under the condition that the bank had a branch in the State whose law would be applicable (alternative A).
وذهب أحد الآراء إلى أنّ تلك المسائل ينبغي أن تخضع للقانون الذي يحكم اتفاق الحساب المصرفي أو القانون الآخر المنصوص عليه في اتفاق الحساب، شريطة أن يكون للمصرف فرع في الدولة التي ينطبق قانونها (البدبل ألف).

[Note to the Commission: The Commission may wish to note that the commentary will explain that the secured creditor with priority has the right to substitute its own enforcement process under this law for judgement enforcement proceedings initiated by a subordinate judgement creditor under other law but does not have the right to continue the enforcement process initiated by the judgement creditor under that other law.]
[ملاحظة إلى الفريق العامل: لعلّ الفريق العامل يودّ أن يلاحظ أنّ التعليق سوف يبيّن أنّ الدائن المضمون ذا الأولوية له الحق في أن يستعيض بعملية الإنفاذ الخاصة به بموجب هذا القانون عن إجراءات الإنفاذ القضائية التي يستهلها دائن بحكم القضاء ذي مرتبة أدنى بموجب قانون آخر، ولكن ليس له الحق في أن يواصل عملية الإنفاذ التي استهلّها هذا الدائن بحكم القضاء بموجب ذلك القانون الآخر.]

Under the Guide, if such other law provides that a security right in such proceeds does exist, then the secured transactions law applies to that security right, except to the extent that the other law applies to [the third-party effectiveness, priority or enforcement of that security right][that security right] (see A/CN.9/631, recommendation 6).
وفي إطار الدليل، إذا كان ذلك القانون الآخر ينص على أن الحق الضماني في هذه العائدات هوحق قائم، فإن قانون المعاملات المضمونة ينطبق من ثم على ذلك الحق الضماني، ما عدا بقدر انطباق ذلك القانون الآخر على [نفاذ ذلك الحق الضماني أو أولويته أو إنفاذه، تجاه الأطراف الثالثة] [ذلك الحق الضماني] (انظر التوصية 6 في الوثيقة A/CN.9/631).

The law should provide that if, under other law, a security right in an excluded type of asset (e.g. immovable property) extends to a type of proceeds to which this law applies (e.g. receivables), this law applies to the security right in the proceeds except to the extent that that other law applies to that security right.
6- وينبغي أن ينص القانون على أنه إذا كان الحق الضماني في نوع مستثنى من الموجودات (مثل الممتلكات غير المنقولة) يشمل، بمقتضى قانون آخر، نوعا من العائدات التي يسري عليها هذا القانون (مثل المستحقات)، فإن هذا القانون ينطبق على الحق الضماني في العائدات ما عدا بقدر انطباق ذلك القانون الآخر على ذلك الحق الضماني.
