59- وتوصي اللجنة الدولة الطرف باتخاذ جميع الخطوات اللازمة لوضع حد لفرض العقوبة الجسدية بموجب الملحوظة 2 من المادة 49 من القانون الجنائي الإسلامي وللبتر والجلد والرجم وغير ذلك من أشكال المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة فيما يخص الأشخاص الذين يمكن أن يكونوا قد ارتكبوا الجرائم قبل بلوغ 18 سنة.

38. The Committee recommends that the State party take all necessary steps to end the imposition of corporal punishment under Note 2 of article 49 of the Islamic Penal Law and the imposition of amputation, flogging, stoning and other forms of cruel, inhuman or degrading treatment and punishment to persons who may have committed crimes while under 18.
38- وتوصي اللجنـة الدولـة الطرف باتخاذ جميع التدابير اللازمة لوقف توقيع العقوبة الجسدية بموجب الفقرة 2 من المادة 49 من القانون الجنائي الإسلامي وفرض بتر الأعضاء، والجلد، والرجم، وسائر أشكال المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، على أشخاص قد يكونون اقترفوا جناياتهم وهم لم يبلغوا من العمر 18 سنة.

52. In the death penalty context it has also been necessary to address the relationship between international legal obligations and sharia law or Islamic criminal law as applied in some countries.
52- وفي سياق عقوبة الإعدام، استلزم الأمر أيضاً الوقوف على العلاقة بين الالتزامات القانونية الدولية والشريعة الإسلامية أو القانون الجنائي الإسلامي حسب تطبيقهما في بعض البلدان.

61. As regards the question of representation of the principal legal systems of the world in the election of the judges, referred to in paragraph 5 of article 6, one representative insisted that the paragraph should specify what the principal legal systems of the world were and should mention Islamic criminal law.
٦١ - وفيما يتعلق بمسألة تمثيل نظم العالم القانونية الرئيسية في انتخاب القضاة، على ما هو مشار إليه في الفقرة ٥ من المادة ٦، أصر ممثل على أن الفقرة يجب أن تحدد النظم القانونية الرئيسية المقصودة وأن تشمل القانون الجنائي الإسلامي.

The fact that it is provided for in the Islamic Criminal Code does not make it a " lawful sanction " but, in the view of the Special Representative, serves only to encourage recourse to such punishment.
