• Indian Penal Code

While certain provisions contained in the Indian Penal Code provide for punishment for various offences against women, there are special legislations to address specific offences.
وفيما ينص بعض الأحكام الواردة في القانون الجنائي الهندي على معاقبة الجرائم المختلفة المرتكبة ضد المرأة، توجد تشريعات خاصة لمعالجة جرائم محددة.

Crimes against women are categorized into two categories, namely, crimes under Indian Penal Code (IPC) and crimes under special and local laws (SLL).
وتصنف الجرائم المرتكبة ضد المرأة في فئتين هما جرائم تندرج في إطار القانون الجنائي الهندي وجرائم تندرج في إطار القوانين الخاصة والمحلية.

The Indian Penal Code also does not provide for any penalty for making or possessing explosive substances with unlawful intent and it does not in other cases always provide such severe penalties as were equisite to meet the increasing number of crimes.
كما أن القانون الجنائي الهندي لا ينص على أي عقوبة بصدد تصنيع المواد المتفجرة أو حيازتها لأغراض غير مشروعة ولا ينص دوما في حالات أخرى على عقوبات بالشدة اللازمة لمنع تزايد عدد الجرائم.

In addition to the constitutional prescriptions, various sections of the Indian Penal Code prohibit infliction of hurt, grievous hurt or bodily harm or injury especially to extract any confessions from any person.
وباﻹضافة إلى ما ينص عليه الدستور من أحكام تحظر مختلف مواد القانون الجنائي الهندي إلحاق أذى أو ألم شديد أو ضرر جسدي أو جرح بأي شخص ولا سيما بقصد انتزاع اعترافات منه.

With regard to the rape of nuns at Jhabua in Madhya Pradesh, which took place on 22/23 September 1998, a case was registered under the Indian Penal Code against 26 persons who were found to be involved.
وفيما يتعلق باغتصاب الراهبات في جابوا بولاية ماديا براديش الذي حصل في 22-23 أيلول/سبتمبر 1998، رُفعت دعوى بموجب القانون الجنائي الهندي ضد 26 شخصا تبيّن تورطهم في الاغتصاب.

115. On familial violence, the Indian Penal Code has been amended to provide a new offence called cruelty to wife by her husband or his relatives which has been made punishable with imprisonment up to three years and a fine.
٥١١- وفيما يخص العنف العائلي تم تعديل القانون الجنائي الهندي كي ينص على جريمة جديدة تسمى قسوة الزوج أو أقاربه على الزوجة، ويعاقب عليها بالسجن لمدة قد تصل إلى ثلاث سنوات وغرامة.

86. Under the Indian Penal Code, extraterritorial offences committed by Indian nationals serving abroad were subject to the jurisdiction of the Indian courts and were punishable under Indian law.
86 - وأضاف قائلاً إن القانون الجنائي الهندي ينص على أن الجرائم التي يرتكبها الرعايا الهنود الذين يعملون خارج نطاق الحدود الإقليمية تخضع لاختصاص المحاكم الهندية وإن القانون الهندي يعاقب عليها.

" Unlawful association " has been defined as any association which has for its object any unlawful activity or encourages any unlawful activity or any activity punishable under section 153(A) or 153(B) of Indian Penal Code.
وقد عُرفت " التنظيمات غير المشروعة " بأنها أي تنظيمات تضطلع بنشاط غير مشروع أو تشجع على نشاط غير مشروع أو نشاط يُعاقب عليه بموجب المادة 153 (ألف) أو المادة 153 (باء) من القانون الجنائي الهندي.

59. Acts of violence, mostly committed by family members predominantly against female relatives who are perceived to have brought dishonour upon the family, referred as Honour Crimes presently dealt with under the provisions of the Indian Penal Code (IPC).
59 - ويتم في الوقت الحالي التعامل بموجب أحكام القانون الجنائي الهندي مع الجرائم التي غالبا ما يرتكبها أفراد الأسرة وفي المقام الأول ضد قريباتهم من النساء اللواتي يعتبر أنهن جلبن العار على أسرهن، وتعرف بجرائم الشرف.

Substantive laws like the Indian Penal Code 1860, special legislations like the Immoral Traffic (Prevention) Act 1956, the Bonded Labour System (Abolition) Act 1976, etc. and local laws like the Goa Children's Act 2003, provide the legal regime.
وتنص قوانين موضوعية مثل القانون الجنائي الهندي 1860، والتشريعات الخاصة مثل قانون عام 1956 (لمنع) الاتجار اللاأخلاقي، وقانون عام 1976 (لإلغاء) نظام السخرة إلخ، والقوانين المحلية مثل قانون غووا لعام 2003 بشأن الأطفال، على الإطار القانوني في هذا الصدد.

The Committee is concerned that the proposed Communal Violence (Prevention, Control and Rehabilitation of Victims) Bill, 2005, does not include sexual and gender-based crimes against women perpetrated during communal violence or create a system of reparations for victims of such crimes, as these elements are not covered effectively by the Indian Penal Code or other relevant legislation.
