95. Despite a landmark ruling of the Supreme Court in 2007 and the initiation of a Commission on Disappeared Persons bill, there have been no major positive developments to resolve disappearance cases or to criminalize enforced disappearance in Nepali law.
95- وعلى الرغم من قرار المحكمة العليا التاريخي الصادر في عام 2007 وطرح مشروع قانون اللجنة المعنية بمسألة المختفين، لا توجد تطورات إيجابية رئيسية في القانون النيبالي لإيجاد حل لقضايا الاختفاء أو تجريم الاختفاء القسري().

81. Although women are dominated in every patriarchal society, Nepalese law has provided the same economic rights to women as men.
81- وبالرغم من أن النساء يخضعن لهيمنة الرجل في جميع المجتمعات الأبوية، يمنح القانون النيبالي النساء والرجال نفس الحقوق الاقتصادية.

90. However, Nepalese law does not allow any restriction or derogation of any of the human rights recognized and established by any legal instrument on the pretext that this Covenant either does not recognize such rights or recognize them to a lesser extent.

The fact that the Constitution makes the protection and promotion of human rights an unamendable element of the Constitution also implies that none of the rights recognized under Nepalese law can be restricted or derogated on the grounds that the Covenant does not recognize those rights.

2.14 The author stresses that under Nepalese law, there are no provisions which set out the individual criminal liability for arbitrary detention, torture or ill treatment, except a very vague and ineffective provision of the Police Act.

5.3 The author stresses that the other body empowered under Nepalese law to investigate the actions of the police or the army is the police.

Serious human rights violations, such as torture, enforced disappearances, and crimes against humanity, which should be prosecuted in accordance to the State's international legal obligations, are still not criminalized under Nepalese law.

57. In relation to sexual offences, Nepalese law definitions focus on " consent " rather than on acts committed, and limit such acts to penetrative sexual intercourse.
