3.3 The author notes that the Committee's jurisprudence provides little guidance on the matter, as the two cases which squarely raised the current point were resolved on other grounds.
3-3 ويشير صاحب البلاغ إلى أن القرارات السابقة للجنة لا تفيد كثيراً في المسألة المطروحة، حيث إن القضيتين اللتين أثارتا بشكل مباشر النقطة الحالية قد جرى حلهما على أسس أخرى.

While the State party recognizes that it has an obligation to protect, it refers to the Committee's jurisprudence in cases of extradition, expulsion or refoulement, in which the analysis of the potential risk that a person could suffer in the jurisdiction of return is made on the basis of the elements available to the State party at the time of transfer.
وفي حين تعترف الدولة الطرف بأن عليها التزاماً بتوفير الحماية، فإنها تحيل إلى القرارات السابقة للجنة في قضايا تتعلق بالتسليم أو الطرد أو الإعادة القسرية التي مفادها أن تقييم الخطر الذي يمكن أن يتعرض له الشخص في إقليم الدولة التي يُعاد إليها يتم على أساس العناصر المتاحة للدولة وقت نقله.

In this regard, the State party refers to the Committee's jurisprudence that it is not for the Committee to evaluate the facts and evidence and interpretation of law in a case, unless it can be shown that the decision was manifestly arbitrary or amounted to a denial of justice.
