The State party should strengthen the capacity of the Judicial and Bar Council, which is responsible for the nomination of candidates, to ensure that vacancies in the judiciary are filled as a matter of urgency.

In the United States, for example, as already lamented by the Special Rapporteur on the independence of judges and lawyers on 16 November 2001, the executive can now direct the trial of non-citizens before military commissions established in such as way as to seriously undermine human rights and the rule of law.

For example, in the year 2003 the Kingdom was visited by Mr. Cumaraswami, the former Special Rapporteur on the independence of judges and lawyers.

53. On 11 October 1999, following the recommendations made by the Chairman of the fiftyfirst session of the SubCommission on the Promotion and Protection of Human Rights, the Special Rapporteur sent a letter to the Government requesting an invitation to visit the country in order to study the situation of the independence of the judiciary and lawyers.
53- وفي 11 تشرين الأول/أكتوبر 1999، وعلى إثر التوصيات التي تقدم بها رئيس الدورة الحادية والخمسين للجنة الفرعية لتعزيز وحماية حقوق الإنسان، وجه المقرر الخاص رسالة إلى الحكومة يطلب فيها توجيه دعوة إليه لزيارة البلد قصد دراسة حالة استقلال القضاء والمحامين.

(d) To study, for the purpose of making proposals, important and topical questions of principle with a view to protecting and enhancing the independence of the judiciary and lawyers and court officials;
(د) دراسة مسائل هامة ومواضيعية تتعلق بالمبدأ بغية حماية وتعزيز استقلال القضاء والمحامين وموظفي المحاكم بغرض تقديم اقتراحات في هذا الشأن؛

(d) To study, for the purpose of making proposals, important and topical questions of principle with a view to protecting and enhancing the independence of the judiciary and lawyers and court officials;
(د) دراسة المسائل المبدئية الهامة والمواضيعية بغية حماية وتعزيز استقلال القضاء والمحامين وموظفي المحاكم بغرض تقديم اقتراحات في هذا الشأن؛

The author also complains that the judiciary and the legal profession was biased against him and stigmatized him on the basis of his psychiatric treatment, in particular in the 1980 civil trial against Dr Herron.
