These are supplemented by the Rules of Court and Practice Directions and by the resolution concerning the internal judicial practice of the Court.
وتكمّلهما لائحة المحكمة والتوجيهات الإجرائية والقرار المتعلق بالممارسة القضائية الداخلية للمحكمة.

The draft Rules of the Tribunal recognize the requirement for a resolution to be formulated by the Tribunal on its internal judicial practice in a manner consistent with the practice of the International Court of Justice.
يقر مشروع لائحة المحكمة بالحاجة الى قرار تصوغه المحكمة بشأن ممارستها القضائية الداخلية بطريقة تتمشى مع الممارسة التي تتبعها محكمة العدل الدولية.

According to another view, the domestic judicial decisions rendered in these cases did not reveal a unified attitude under international law and instead focused on the responsibility of member States under domestic law.

باء - القرار المتعلق بالممارسات القضائية الداخلية للمحكمة

This followed almost immediately after the conclusion of the fourth session of the Tribunal and the adoption of its Rules, the Resolution on internal judicial Practice and the Guidelines concerning the Preparation and Presentation of Cases before the Tribunal.
وقد حدث ذلك عقب اختتام الدورة الرابعة للمحكمة مباشرة تقريبا، واعتماد نظامها، والقرار المتعلق بالممارسات القضائية الداخلية للمحكمة، والمبادئ التوجيهية المتعلقة بإعداد القضايا وعرضها على المحكمة.

The President of the Meeting noted that States needed to be familiar with the Tribunal's internal judicial practice and the guidelines for the preparation and submission of cases before the Tribunal, in order to avail themselves of its dispute settlement services.
وقال رئيس الاجتماع إن الدول بحاجة إلى أن تكون على دراية تامة بالممارسة القضائية الداخلية للمحكمة وبالمبادئ التوجيهية لإعداد وتقديم القضايا للمحكمة ليتسنى لهم الاستفادة من خدماتها في تسوية المنازعات.

I have been informed that the Tribunal at its last session adopted its rules, a resolution on its internal judicial practice and a set of guidelines concerning the preparation and presentation of a case before the Tribunal.

الفرع ٥ - الممارسة القضائية الداخلية

Article 32, concerning access on a non-discriminatory basis to domestic judicial systems, reflects a growing realization by States that judicial systems often do not permit those harmed by transboundary pollution to seek redress because non-citizens and non-residents do not have equal access to judicial systems.
وتعكس المادة ٣٢ المتعلقة باللجوء دون تمييز إلى النظم القضائية الداخلية إدراكا متزايدا لدى الدول بأن النظم القضائية، في كثير من اﻷحيان، لا تسمح للمتضررين من التلوث العابر للحدود بطلب الجبر ﻷن فرص لجوء غير المواطنين وغير المقيمين الى النظم القضائية غير متكافئة.

4.2 According to the State party, the complainant declared, during the domestic judicial proceedings, that he had been arrested in 2003 near the University of Teheran on suspicion of having taken part in the university revolt of Kuye Daneshgah.
4-2 ووفقاً لما تقوله الدولة الطرف، فإن صاحب الشكوى قد صرّح في إطار الإجراءات القضائية الداخلية بأنه اعتُقل في عام 2003 قرب جامعة طهران، بسبب الاشتباه في مشاركته في الانتفاضة الجامعية لكويي دانيشغاه.

Consequently, she contends that the application of the remedies available to her under the domestic law has been unreasonably prolonged.
وبهذا، تؤكد صاحبة البلاغ أن إجراءات مرحلة التحقيق المتاحة لها في إطار الولاية القضائية الداخلية للبلد قد طال أمدها على نحو غير مبرَّر.

With regard, in particular, to the question of the exhaustion of domestic remedies, the State party stresses that none of the communications passed through the domestic courts to allow for consideration by the Algerian judicial authorities.
وفيما يتعلق بمسألة استنفاد سبل الانتصاف المحلية بصورة خاصة، تؤكد الدولة الطرف أنه لم يخضع أي من البلاغات التي قدمها أصحابها للمسار القضائي الذي يمكّن السلطات القضائية الداخلية من أن تنظر فيها.

It also was necessary to exclude international juridical events, such as various notifications which did not entail an intention on the part of the author to become bound thereby, including fairly common situations in which internal juridical acts became, at the international level, simple juridical events.
وينبغي أيضا استبعاد اﻷعمال القضائية الدولية كاﻹخطارات المختلفة التي لا تشتمل على نية الالتزام من جانب القائم بها، بما في ذلك الحالات المتكررة الحدوث التي تتحول فيها اﻷعمال القضائية الداخلية على الصعيد الدولي لتصبح وقائع قضائية بسيطة.

Sanctions have no moral basis, as they not only hinder the economic and social development of peoples, but also interfere in matters that are essentially within the domestic jurisdiction of the country concerned.
إن الجزاءات لا أساس أخلاقيا لها، إذ أنها لا تعرقل التقدم الاقتصادي والاجتماعي للشعوب فحسب لكنها تتدخل أيضا في المسائل التي هي الأساس من اختصاص الولاية القضائية الداخلية للدول المعنية.

Lower-level perpetrators will continue to be subject to local/ domestic prosecutions and there may, in the future, be a truth and reconciliation process of some kind.
