The President of the Tribunal is responsible for deciding the number of days necessary for judges ad hoc to participate in the work of the Tribunal related to the cases for which they have been appointed and their attendance at the seat of the Tribunal, in Hamburg.

3. Therefore, provided that the revised annual salary system results in a lower annual salary for new members of the Court or lower compensation for newly appointed ad hoc judges than for members of the Court or ad hoc judges elected prior to 1 January 2007, the concerns raised by President Higgins and Registrar Couvreur regarding the principle of equality of members of the Court are justified.

Unambiguously, Article 31, paragraph 6, of the Statute and article 7, paragraph 2, of the Rules, require that ad hoc judges shall sit on terms of " complete equality " with members of the Court. The rationale is the same as that requiring full equality among members of the Court.

With regard to the phase of the procedure concerning the preliminary objections, the Court, taking into account the presence upon the Bench of judges of British, Dutch and French nationality, decided that the judges ad hoc chosen by the respondent States should not sit during that phase.
