While it is true that the Dublin Regulation provides that unaccompanied minors are to be sent to a member State where a parent or guardian is present, this is often not carried out in practice due to lack of capacity and coordination.

The State party should hasten the adoption of the revised law on the status of refugees to consolidate safeguards for protecting refugees, asylum seekers, internally displaced persons and stateless persons, including by setting up a body to rule on applications for refugee status and on a range of issues such as family reunification and the protection of unaccompanied minors.
ينبغي للدولة الطرف التعجيل باعتماد القانون المنقح بشأن وضع اللاجئين من أجل دعم ضمانات حماية اللاجئين وملتمسي اللجوء والمشردين داخلياً وعديمي الجنسية، ولا سيما من خلال إنشاء هيئة للبت في طلبات منح وضع اللاجئ وطائفة من القضايا منها إعادة شمل الأسرة وحماية القُصر غير المصحوبين.

33. With regard to the situation of certain categories of children, especially unaccompanied minors, the Special Rapporteur gathered the following information concerning children living and working in the street and children affected by lasting psychological trauma caused by the war.

34. Government of the Sudan representatives again raised the question of SPLA- conducted enforced conscriptions of minors, including the case of the unaccompanied minors sent to Cuba from Ethiopian refugee camps in the late 1980s.
٣٤ - وأثار ممثلو حكومة السودان مرة أخرى مسألة قيام الجيش الشعبي لتحرير السودان بالتجنيد اﻹجباري للقُصر، بما في ذلك القُصر غير المصحوبين بذويهم الذين أرسلوا إلى كوبا من معسكرات اللاجئين في إثيوبيا في أواخر عقد الثمانينات.

5. “unaccompanied minors” or “separated children” are defined as those who are separated from both parents and are not being cared for by an adult who, by law or custom, is responsible for doing so.
ثانيا - معلومات أساسية ٥ - عُرف مصطلح " القُصر غير المصحوبين " أو " اﻷطفال المنفصلين عن ذويهم " بأنهم أطفال انفصلوا عن والديهم ولا يتلقون الرعاية من أي شخص بالغ يكون، بحكم القانون أو العرف، مسؤولا عن القيام بذلك.

٥ - القُصر غير المصحوبين

The Special Rapporteur on the human rights of migrants recommended that Italy establish a comprehensive mechanism for the identification of unaccompanied minors that included not only medical examinations but also a psychosocial and cultural approach, in order to best identify specific protection measures in the best interests of each child.
وأوصى المقرر الخاص المعني بحقوق الإنسان للمهاجرين بأن تنشئ إيطاليا آلية شاملة لتحديد هوية القُصر غير المصحوبين بذويهم، تشمل الفحوصات الطبية ونهجاً نفسياً اجتماعياً وثقافياً، بغية تحديد تدابير الحماية المحددة على أفضل نحو بما يحقق المصالح الفضلى لكل طفل(143).

Ensure that all unaccompanied minors are provided with a legal guardian immediately after crossing the border and are provided with legal assistance at all stages of the application for international protection; systematically train staff of the Social Work Centres on how to uphold the best interests of the unaccompanied minors and provide these Centres with adequate support;
(أ) تأمين وصي قانوني لجميع القُصر غير المصحوبين فور عبورهم الحدود وتقديم المساعدة القانونية لهم في جميع مراحل إجراءات طلب الحماية الدولية؛ وتدريب موظفي مراكز العمل الاجتماعي على نحو منتظم بشأن كيفية الحفاظ على المصالح الفضلى للقصر غير المصحوبين وتزويد هذه المراكز بالدعم الكافي؛
