It also urged Cambodia to implement the Basic Principles on the Role of Lawyers, and to accept requests for visit by the Special Rapporteur on the independence of judges and lawyers.

48. With regard to the legal profession, the Basic Principles on the Role of Lawyers require Governments to ensure that lawyers are able to perform all of their professional functions without intimidation, hindrance, harassment or other improper interference.
48 - فيما يخص المهن القانونية، تشترط المبادئ الأساسية المتعلقة بدور المحامين أن تكفل الحكومات للمحامين القدرة على أداء جميع وظائفهم المهنية بدون ترهيب أو إعاقة أو مضايقة أو تدخُّل غير لائق.

81. A provision of principle 26 of the Basic Principles on the Role of Lawyers is that codes of professional conduct for lawyers should be established by the legal profession or by legislation in accordance with national laws and recognized international standards and norms.
81 - وينص الحكم الوارد في المبدأ 26 من المبادئ الأساسية المتعلقة بدور المحامين على أن يجري عن طريق العاملين في المهن القانونية أو بواسطة التشريعات وضع مدونات للسلوك المهني للمحامين توافق القوانين الوطنية والمعايير والقواعد الدولية المعترف بها.

In this context, the Special Representative recalls Commission resolution 2001/39 of 23 April 2000, and the Basic Principles on the Role of Lawyers adopted by the Eighth United Nations Congress on the Prevention of Crime and Treatment of Offenders and welcomed by the General Assembly in resolution 45/166 of 18 December 1990.

the Basic Principles on the Role of Lawyers provide that Governments must ensure that lawyers have appropriate education and training, so as to be able to advise and protect the rights of their clients and uphold the cause of justice.

The Committee also recommends that the State party should ensure compliance with the Basic Principles on the Role of Lawyers (Eighth United Nations Congress on the Prevention of Crime and the Treatment of Offenders, Havana, 27 August to 7 September 1990 [A/CONF.144/28/Rev.1], p. 118).
وتوصي اللجنة الدولة الطرف أيضاً بضمان احترام المبادئ الأساسية المتعلقة بدور المحامين (مؤتمر الأمم المتحدة الثامن لمنع الجريمة ومعاملة المجرمين، المعقود في هافانا، من 27 آب/أغسطس إلى 7 أيلول/سبتمبر 1990 ((A/CONF/144/28/Rev.1)، الصفحة 118).

Thus, in addition to free legal aid for criminal proceedings, the Basic Principles on the Role of Lawyers require Governments to ensure the provision of sufficient funding and other resources (for example legal services) to the poor and other disadvantaged persons.

16. Similarly, Mr. Al-Bachr has not benefited from any legal procedure, access to a lawyer or legal assistance in violation of article 10 of the Universal Declaration of Human Rights, Principle 1 of the Basic Principles on the Role of Lawyers and Principle 18 of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment.
16- وبالمثل لم يستفد السيد البشر من أي إجراء قانوني، كالاتصال بمحام أو الحصول على مساعدة قانونية، وهذا يمثل انتهاكاً للمادة 10 من الإعلان العالمي لحقوق الإنسان، وللمبدأ الأول من المبادئ الأساسية المتعلقة بدور المحامين، وللمبدأ الثامن عشر من مجموعة المبادئ المتعلقة بحماية جميع الأشخاص الذين يتعرضون لأي شكل من أشكال الاحتجاز أو السجن.

14. Given absence of any legal procedure, let alone fair trial, the detention of Mr. Al Qahtani also runs contrary to article 10 of the Universal Declaration of Human Rights as well as principle 1 of the Basic Principles on the Role of Lawyers and principle 18 of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment.
14- ونظراً إلى غياب أي إجراءات قانونية، ناهيك عن المحاكمة العادلة، يتعارض احتجاز السيد القحطاني أيضاً مع المادة 10 من الإعلان العالمي لحقوق الإنسان، والمبدأ 1 من المبادئ الأساسية المتعلقة بدور المحامين، والمبدأ 18 من مجموعة المبادئ المتعلقة بحماية جميع الأشخاص الذين يتعرضون لأي شكل من أشكال الاحتجاز أو السجن.

18. Given the absence of any legal procedure, let alone fair trial, Mr. Al-Ghamdi's detention also runs contrary to article 10 of the Universal Declaration of Human Rights, Principle 1 of the Basic Principles on the Role of Lawyers and Principle 18 of the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment.
18- ونظراً إلى غياب أي إجراءات قانونية، ناهيك عن المحاكمة العادلة، يتعارض احتجاز السيد الغامدي أيضاً مع المادة 10 من الإعلان العالمي لحقوق الإنسان، والمبدأ 1 من المبادئ الأساسية المتعلقة بدور المحامين، والمبدأ 18 من مجموعة المبادئ المتعلقة بحماية جميع الأشخاص الذين يتعرضون لأي شكل من أشكال الاحتجاز أو السجن.

The State party should review the compatibility of the proposed draft law on lawyers' activity and the Bar with its obligations under article 14 of the Covenant, as well as article 22 of the Basic Principles on the Role of Lawyers and refrain from taking any measures that constitute harassment or persecution of lawyers and unnecessarily interfere with their defence of clients.
ينبغي أن تستعرض الدولة الطرف مواءمة مشروع القانون المقترح المتعلق بنشاط المحامين ونقابتهم مع التزاماتها بموجـب المادة 14 من العهد، والمادة 22 كذلك من " المبادئ الأساسية المتعلقة بدور المحامين " وأن تمتنع عن اتخاذ أي تدابير تكون بمثابة مضايقة أو اضطهاد للمحامين وعدم التدخل دون مسوغ في عملهم المتعلق بالدفاع عن موكليهم.

11. The preamble of the Basic Principles on the Role of Lawyers stipulates that " adequate protection of the human rights and fundamental freedoms to which all persons are entitled, be they economic, social and cultural, or civil and political " requires " that all persons have effective access to legal services provided by an independent legal profession [...] " .
11 - وتنص ديباجة المبادئ الأساسية المتعلقة بدور المحامين() على أن " الحماية الكاملة لحقوق الإنسان والحريات الأساسية المقررة لجميع الأشخاص، اقتصادية كانت أو اجتماعية أو ثقافية أو مدنية أو سياسية " تقتضي " حصول جميع الأشخاص فعلا على خدمات قانونية يقدمها مهنيون قانونيون مستقلون [...] " ().

Nevertheless, he is convinced that such reductions are necessary to bring Turkish practice up to international standards (as reflected in the case law of the Human Rights Committee with respect to the International Covenant on Civil and Political Rights, and in the Basic Principles on the Role of Lawyers) and European standards (as reflected in the case law of the European Court of Human Rights).

31. The Special Rapporteur would like to point out that Principle 9 of the Basic Principles on the Role of Lawyers provides that Governments must ensure that lawyers have appropriate education and training, so as to be able to exercise the rights and duties set out in Principles 12 to 15, consisting primarily in advising and protecting the rights of their clients and in upholding the cause of justice.
