According to the Committee on Economic, Social and Cultural Rights and as reiterated in the basic principles and guidelines on development-based evictions and displacement, evictions can take place only in the " most exceptional circumstances " .

In this regard, the Special Rapporteur encourages States to refer to the basic principles and guidelines on Development-Based Evictions and Displacement formulated by the Special Rapporteur on adequate housing (A/HRC/4/18, annex).

By resolution 2005/30, the Council took note of Commission on Human Rights resolution 2005/35 of 19 April 2005, in which the Commission adopted the text of the basic principles and guidelines on the Right to a Remedy and Reparation for Victims of Gross Violations of International Human Rights Law and Serious Violations of International Humanitarian Law, and recommended to the General Assembly that it adopt the Basic Principles and Guidelines.

The right to effective remedy is recognized under international human rights law and has been detailed in General Assembly resolution 60/147, by which the Assembly adopted the basic principles and guidelines on the Right to a Remedy and Reparation for Victims of Gross Violations of International Human Rights Law and Serious Violations of International Humanitarian Law.
