٧ - وكان اعلان المبادىء القانونية بمثابة الخطوة اﻷولى التي تتخذها اﻷمم المتحدة في سياق التطوير التدريجي لقانون الفضاء الدولي .

6. Nothing contained in this Convention shall affect the principle that the description of the offences established in accordance with this Convention and of the applicable legal defences or other legal principles controlling the lawfulness of conduct is reserved to the domestic law of a State Party and that such offences shall be prosecuted and punished in accordance with that law.
6- ليس في هذه الاتفاقية ما يمس بالمبدأ القائل بأن توصيف الجرائم المقررة وفقا لهذه الاتفاقية وتوصيف الدفوع القانونية المنطبقة أو المبادىء القانونية الأخرى التي تحكم مشروعية السلوك محفوظ حصرا لقانون الدولة الطرف الداخلي، وبوجوب ملاحقة ومعاقبة تلك الجرائم وفقا لذلك القانون.

Some delegations expressed the view that, with the rapid evolution of technology and organization of space activities, the Legal Subcommittee needed to maintain its leading role in the development of legal principles and the identification of improvements to the existing legal principles and instruments governing the peaceful use of outer space.
٨٥ - ورأت بضعة وفود أنه يتعين على اللجنة الفرعية القانونية ، نظرا لسرعة تطور التكنولوجيا وتنظيم اﻷنشطة الفضائية ، أن تواصل أداء دورها القيادي في صوغ المبادىء القانونية وادخال تحسينات على المبادىء والصكوك القانونية الحالية التي تنظم استخدام الفضاء الخارجي في اﻷغراض السلمية .

One delegation emphasized the importance of ensuring procedural safeguards and suggested that either a separate paragraph should deal with that issue or all relevant paragraphs should refer to “fundamental legal principles”.
وشدد أحد الوفود على أهمية ضمان وجود تدابير وقائية اجرائية ، واقترح إما تناول هذه المسألة في فقرة منفصلة وإما أن تشير جميع الفقرات ذات الصلة الى " المبادىء القانونية اﻷساسية " .

الدول اﻷطراف ]، عندما لا يتعارض ذلك مع المبادىء القانونية اﻷساسية ،[ أن تعتمد تدابير كافية للسماح بنقل أي شخص محتجز في دولة طرف ويطلب حضوره في دولة طرف أخرى لتقديم أدلة أو للمساعدة في التحقيقات ، اذا رضي الشخص بذلك ووافقت عليه السلطات المختصة في كلتا الدولتين .اقترح أحد الوفود ادراج الفقرة ٠٢ بعد هذه الفقرة مباشرة .

313. The international legal principles in the five treaties10 have established the exploration and use of outer space as the province of all humankind, outer space, including the Moon and other celestial bodies not subject to national appropriation, and have ensured freedom of exploration.
٣١٣ - وتقرر المبادىء القانونية الدولية الواردة في المعاهدات الخمس)٠١( أن استكشاف الفضاء الخارجي واستخدامه هو مجال متاح لجميع البشر ، وأن الفضاء الخارجي ، بما فيه القمر وجميع اﻷجرام السماوية ، لا يخضع لتملك وطني ، وكفلت حرية استكشافه .

As a result of the deliberations held during those sessions, the Declaration of legal principles Governing the Activities of States in the Exploration and Use of Outer Space was adopted unanimously by the General Assembly in its resolution 1962 (XVIII) of 13 December 1963.
ونتيجة للمداولات التي دارت خلال هاتين الدورتين ، اعتمدت الجمعية العامة بالاجماع اعلان المبادىء القانونية المنظمة ﻷنشطة الدول في ميدان استكشاف الفضاء الخارجي واستخدامه ، الوارد في قرارها ٢٦٩١ )د-٨١( المؤرخ ٣١ كانون اﻷول/ديسمبر ٣٦٩١ .
