وهي توضّح أنَّ كلاً من المعايير الموضوعية المبيّنة في المواد 2 إلى 6 يخضع للاستثناءات المحدودة المبيّنة في المادة 7.

In addition to citing relevant legislation, Egypt reported that many bodies were involved in the implementation of the principles set forth in article 5 of the Convention, among them the public prosecution and the integrity and transparency committee.
وبالإضافة إلى ذكر التشريعات ذات الصلة، أبلغت مصر أن كثيرا من الأجهزة تشارك في تنفيذ المبادئ المبيّنة في المادة 5 من الاتفاقية، منها النيابة العامة ولجنة النـزاهة والشفافية.

(d) The supplier or contractor presenting the successful submission is excluded from the procurement proceedings on the grounds specified in article 21 of this Law.
(د) يُستبعَد المورِّدُ أو المقاول الذي قدَّم العرضَ الفائز من إجراءات الاشتراء للأسباب المبيّنة في المادة 21 من هذا القانون.

The State party should also review the need for extending the state of emergency in the light of the criteria laid down in article 4 of the Covenant, to which Algeria is a party.
وينبغي للدولة الطرف أيضاً مراجعة الحاجة إلى تمديد حالة الطوارئ في ضوء المعايير المبيّنة في المادة 4 من الاتفاقية التي تكون الجزائر طرفاً فيها.

4. If an objection has been raised within the prescribed time limit, the States parties concerned shall seek a solution through the means indicated in Article 33 of the Charter of the United Nations.
" 4 - في حال الاعتراض في غضون المهلة الزمنية المحددة، على الدول الأطراف أن تلتمس حلاً بالوسائل المبيّنة في المادة 33 من ميثاق الأمم المتحدة.

These exceptions, spelled out in article 8, concern both the obligation of the successor State to attribute its nationality and the power of the State to do so.
وهذه الاستثناءات، المبيّنة في المادة 8، تتعلق بكلّ من التزام الدولة الخلف بإعطاء جنسيتها وسلطة الدولة على أن تفعل ذلك.

2. The operation of the procedures and mechanisms on compliance shall be guided by the principles set out in article 3 of the Convention, and shall:
2- يسترشد إعمال الإجراءات والآليات المتصلة بالامتثال بالمبادئ المبيّنة في المادة 3 من الاتفاقية على النحو التالي:

(a) Select the type of framework agreement to be concluded from among the types set out in article 22 ter;
(أ) تختار نوع الاتفاق الإطاري المراد إبرامه من بين الأنواع المبيّنة في المادة 22 مكررا ثانيا؛

4. The operation of the [procedures and mechanisms relating to compliance] [compliance system] shall [be guided by] [be based on] the [principles set out in article 3 of the Convention] [and the recognized principles under international law] [and in particular shall]:
4- [يسترشد] [يستند] إعمال [الاجراءات والآليات المتصلة بالامتثال] [نظام الامتثال] [ب] [إلى] [المبادئ المبيّنة في المادة 3 من الاتفاقية] [والمبادئ المعترف بها بموجب القانون الدولي] [وبوجه خاص]:

(b) If he finds himself in one of the situations set out in article 4 (see paragraphs 33—34 below);
)ب( إذا أوجد نفسه في إحدى الحالات المبيّنة في المادة )٤( )انظر الفقرتين ٣٣-٤٣ أدناه(؛

In particular, it was questioned whether there should be an automatic suspension in the cases set out in article 20 (3); and
وأثير على وجه الخصوص تساؤل عما إذا كان ينبغي أن يكون هناك إيقاف تلقائي في جميع الحالات المبيّنة في المادة (20) (3)؛

13. The Committee is concerned that the State party's domestic legislation continues to omit a definition of racial discrimination conforming to all the elements set out in article 1 of the Convention.
13- يساور القلق اللجنة إزاء كون التشريعات المحلية في الدولة الطرف لا تزال تخلو من تعريف للتمييز العنصري يشتمل على جميع العناصر المبيّنة في المادة 1 من الاتفاقية.

The author claims that the court based its reasoning only on the police report and did not considered whether the restriction of her right to impart information was necessary to achieve any of the legitimate aims set out in article 19 of the Covenant.
وتدّعي صاحبة البلاغ أن المحكمة لم تستند في تحليلها إلا على محضر الشرطة ولم تراعِ ما إذا كان القيد المفروض على حقها في نقل المعلومات لازماً لتحقيق أي غرض من الأغراض المشروعة المبيّنة في المادة 19 من العهد.

1. Each State Party shall, to the extent appropriate and in accordance with its domestic law, adopt legislative, administrative or other effective measures to promote integrity and to prevent, detect and punish the corruption of public officials, in addition to the measures set forth in article [...] [Measures against money-laundering] of this Convention.
1- تعتمد كل دولة طرف، بالقدر المناسب لقانونها الداخلي ووفقا له، تدابير تشريعية أو إدارية أو تدابير فعّالة أخرى، اضافة إلى التدابير المبيّنة في المادة [...] [تدابير مكافحة غسل عائدات الفساد] من هذه الاتفاقية، لتعزيز نزاهة الموظفين العموميين ومنع فسادهم وكشفه ومعاقبته.

The expulsions in August and those announced for 31 December, which have apparently been suspended, do not satisfy these criteria, nor do they comply with the guarantees relating to expulsion set forth in article 32 which must, for obvious reasons, extend to persons returned to a country in which they have grounds to fear they will be persecuted (reasonable period, submission of evidence to clear himself, due process of law).
وعمليات الطرد التي حصلت في آب/أغسطس والعمليات التي أعلن أنها ستحصل في ١٣ كانون اﻷول/ديسمبر والتي عُلّق تنفيذها فيما يبدو لا تفي بهذه المعايير ولا تمتثل للضمانات المتصلة بالطرد المبيّنة في المادة ٢٣، وهي ضمانات يجب أن تشمل، ﻷسباب بديهية، اﻷشخاص العائدين الى البلد الذي لديهم أسباب وجيهة للخوف من أن يُضطهدوا فيه )الفترة المعقولة، وتقديم اﻷدلة ليثبت الشخص براءته، واحترام قواعد اﻹجراءات القانونية(.

(k) Further requests its secretariat, subject to the availability of extrabudgetary resources, to collect and make available to States parties successful practices with respect to investigations of offences covered by the Protocol against the Smuggling of Migrants by Land, Sea and Air and the provision of protection and assistance measures to persons who have been the object of conduct set forth in article 6 of that Protocol;
(ك) يطلب كذلك إلى أمانته أن تقوم، رهنا بتوفّر الموارد من خارج الميزانية، بجمع الممارسات الناجحة المتّبعة في إجراء التحقيقات في الجرائم المشمولة ببروتوكول مكافحة تهريب المهاجرين عن طريق البر والبحر والجو وإتاحتها للدول الأطراف، وتوفير تدابير الحماية والمساعدة للأشخاص الذين وقعوا ضحية الأفعال المبيّنة في المادة 6 من ذلك البروتوكول؛

(d) The supplier or contractor presenting the successful submission is excluded from the procurement proceedings on the grounds specified in article 20 of this Law.
(د) أو يُستبعَد المورِّد أو المقاول الذي قدم العرض الفائز من إجراءات الاشتراء للأسباب المبيّنة في المادة 20 من هذا القانون.

(1) (a) When the procuring entity engages in procurement by means of restricted tendering on the grounds specified in article 28 (1) (a) of this Law, it shall solicit tenders from all suppliers and contractors from which the subject matter of the procurement is available;
(1) (أ) عندما تقوم الجهة المشترية بالاشتراء بواسطة المناقصة المحدودة بناءً على الأسباب المبيّنة في المادة 28 (1) (أ) من هذا القانون، تلتمس العطاءات من جميع المورِّدين والمقاولين المتاح لديهم الشيء موضوع الاشتراء؛

" If an objection has been raised within the prescribed time limit, the States parties concerned shall seek a solution through the means indicated in Article 33 of the Charter of the United Nations. " This text would be preceded by the current paragraph 3 of draft article 8.
" في حال الاعتراض في غضون المهلة الزمنية المحددة، على الدول الأطراف المعنية أن تلتمس حلاً بالوسائل المبيّنة في المادة 33 من ميثاق الأمم المتحدة " ، على أن يسبق هذا النص الفقرة 3 من مشروع المادة 8 الحالي.

In that connection, the Committee notes that there is no possibility of recourse, either to the courts or to the National Assembly, to determine the legality of the author's exclusion or its necessity for the purposes spelled out in article 19 of the Covenant.
وفي هذا الصدد، تلاحظ اللجنة أنه لا توجد إمكانية اللجوء لا إلى المحاكم ولا إلى الجمعية الوطنية لتحديد قانونية الإقصاء أو ضرورته للأغراض المبيّنة في المادة 19 من العهد.
