It was suggested that the proposal contained in paragraph 69 above be amended to allow either the claimant or the respondent to object to the publication of the notice of arbitration without conditioning the objection on limitations to transparency set out in section 6.

In response to a concern, it was clarified that the need to protect sensitive and confidential information would be covered by limitations to be further defined under the rules on transparency (see below, paras. 129 to 147) (referred to as " limitations to transparency set out in section 6 " ).
