ويقصد بهذه الصيغة التعبير عن الحاجة إلى إقامة صلة وثيقة بين التصرف المتجاوز لحدود السلطة ووظائف الجهاز أو المسؤول.

Paragraph (7) of the commentary suggests that since the discussion of ultra vires conduct of an organ is set out in draft article 6, draft article 4 deals with conduct by an organ that is not ultra vires, but is still wrongful.
