This is only acceptable in the following instances: a) where it can be demonstrated that the consultant or individual contractor is the only available source of the required service at an acceptable level of quality and cost; and/or b) where it can be demonstrated that a true emergency situation prevents a competitive selection process.

A consultant or individual contractor would initiate an arbitration case by submitting his or her request for arbitration and statement of claim to the respondent United Nations entity and the corresponding initial deposit of the arbitrator's fixed fee to the neutral entity, as specified in paragraph 19 above.
