Finally, the State party contends that contrary to the author's allegations, the Terrorist and Destructive Activities Ordinance 2004 does not grant immunity to security forces.

26. No new cases of arrest under the Terrorist and Disruptive Activities (Control and Prevention) Ordinance were reported.

The Superintendent specified that the author had been found to have been involved in " Maoist terrorist activities " , and requested that the author be preventively detained under section 9 of the Terrorist and Destructive Activities Ordinance.
وبيّن مدير الشرطة أنه كان قد ثبت ضلوع صاحب البلاغ في " أنشطة إرهابية ماوية " وطلب حبسه احتياطياً بموجب المادة 9 من الأمر القانوني المتعلق بالأنشطة الإرهابية والتخريبية.

The Committee took note of the State party's contention that the author was arrested on 29 July 2004 under the Terrorist and Disruptive Activities (Control and Punishment) Act of 2004, adopted in the context of the state of emergency declared by the State party, and allowing the arrest and detention of suspects for a period of up to one year.
وأحاطت اللجنة علماً بدفع الدولة الطرف بأن صاحب البلاغ اعتُقل في 29 تموز/يوليه 2004 بموجب القانون المتعلق بالأنشطة الإرهابية والتخريبية لعام 2004 الذي اعتُمد في سياق حالة الطوارئ التي أعلنتها الدولة الطرف، ويتيح اعتقال واحتجاز المشتبه بهم لفترة قد تصل إلى سنة كاملة.

On 12 May 2005, the Lieutenant of Kalidal Battalion, Immamnagar Barracks, wrote a letter to the DPO regarding the author, and recommending that he be preventively detained pursuant to section 9 of the Terrorist and Destructive Activities (Control and Punishment) Ordinance (2004).
وفي 12 أيار/مايو 2005، وجّه ملازم كتيبة كاليدال في ثكنة إمّامْناغار خطاباً إلى مكتب شرطة المقاطعة بشأن صاحب البلاغ أوصى فيه بحبسه احتياطياً عملاً بالمادة 9 من الأمر القانوني المتعلق بالأنشطة الإرهابية والتخريبية (مكافحتها والمعاقبة عليها) (2004)().

5.5 Regarding the basis for the author's arrest, the author stresses that he was only arrested under the Terrorist and Destructive Activities Ordinance of 2004 on 13 May 2005, i.e. 12 1/2 months after his initial arrest.
5-5 وفيما يتعلق بالأساس القانوني لاعتقال صاحب البلاغ، يشدد هذا الأخير على أنه لم يُعتقل بالاستناد إلى الأمر القانوني المتعلق بالأنشطة الإرهابية والتخريبية لعام 2004 إلاّ في يوم 13 أيار/مايو 2005، أي بعد اثني عشر شهراً ونصف على اعتقاله للمرة الأولى.

The same applies for actions under the Terrorist and Disruptive Activities (Control and Punishment) Ordinance, 2004, under which the author was detained from 29 July to 26 October 2004.
ويسري هذا أيضاً على الأفعال التي تدخل في إطار الأمر المتعلق بالأنشطة الإرهابية والتخريبية (مكافحتها والمعاقبة عليها)، 2004، الذي احُتجز صاحب البلاغ بموجبه من 29 تموز/يوليه إلى 26 تشرين الأول/أكتوبر 2004.

The author further submits that, in failing to inform him of the legal grounds of his arrest or of any charge against him until he was given a detention order under the Terrorist and Disruptive Activities (Control and Punishment) Act on 29 July 2004, the State party breached article 9, paragraph 2.
ويدفع صاحب البلاغ أيضاً بأن الدولة الطرف، بتخلفها عن إعلامه بالأسباب القانونية لاعتقاله والتهم الموجهة إليه إلى حين تسليمه في 29 تموز/يوليه 2004 أمر احتجاز بموجب القانون المتعلق بالأنشطة الإرهابية والتخريبية (مكافحتها والمعاقبة عليها)، تكون قد انتهكت الفقرة 2 من المادة 9.
