أولا- ملاحظات بشأن مشروع الإعلان المتعلق بتفسير الفقرة (2) من المادة الثانية والفقرة (1) من المادة السابعة من اتفاقية نيويورك ثانيا-

8. For an appeal grounded on the interpretation or application of one or more of the CDM rules and requirements, all of the following elements must be present and argued:

Taking the view that guidance on interpretation of the article would be useful in achieving the objective of ensuring uniform interpretation that responded to the needs of international trade, the Working Group decided that a declaration, resolution or statement addressing the interpretation of the New York Convention that would reflect a broad understanding of the form requirement could be further studied to determine the optimal approach.
وإذ رأى الفريق العامل أن التوجيه المتعلق بتفسير هذه المادة سيكون مفيداً في تحقيق الهدف الرامي إلى كفالة وضع تفسير موحد يلبي احتياجات التجارة الدولية، قرر أن إصدار إعلان أو قرار أو بيان يتناول تفسير اتفاقية نيويورك ويتجلى فيه فهم عريض لاشتراط الشكل يمكن أن يخضع لمزيد من الدراسة بغية تقرير النهج الأمثل.

25. With regard to draft conclusion 3, on interpretation of treaty terms as capable of evolving over time, his delegation attached importance to the question of so-called intertemporal law. In particular, it supported the interpretation of a treaty in the light of existing circumstances and law in respect of critical matters, such as questions relating to State borders, sovereignty rights and the exercise of jurisdiction in certain areas.
25 - وفي ما يتعلق بمشروع الاستنتاج 3 المتعلق بتفسير أحكام المعاهدات باعتباره قابلا للتطور بمرور الزمن، قال إن وفده يُعلّق أهمية على مسألة ما يسمى قانون السريان الزمني، ويؤيد على وجه الخصوص تفسير المعاهدة في ضوء الظروف والقوانين السائدة فيما يتعلق بمسائل حساسة مثل المسائل المتصلة بحدود الدول والحقوق السيادية وممارسة الولاية القضائية في مجالات معينة.

The Human Rights Committee, in its general comment No. 23 addressing the interpretation of the sentence in article 27 that " persons belonging to ... minorities shall not be denied their right to enjoy their own culture " , observed that
