التوجيه 3: حقوق أخرى للأشخاص المحتجزين أو المقبوض عليهم أو المشتبه بهم أو المتهمين بارتكاب جريمة

62. The budget for legal aid should cover the full range of services to be provided to persons detained, arrested or imprisoned, suspected or accused of, or charged with a criminal offence, and to victims.
62 - وينبغي أن تغطي ميزانية المساعدة القانونية المجموعة الكاملة من الخدمات المقرر تقديمها إلى الأشخاص المحتجزين أو المقبوض عليهم أو السجناء أو المشتبه بارتكابهم جريمة أو المتهمين بارتكاب جريمة وإلى الضحايا.

73. Persons charged with a criminal offence have a right to a minimum of guarantees in criminal proceedings enshrined in article 14 (3) of the Covenant.
73 - وللأشخاص المتهمين بارتكاب جريمة جنائية الحق في الضمانات الدنيا التي تمنح أثناء الإجراءات الجنائية والتي تنص عليها المادة 14 (3) من العهد.

It shall ensure in particular that persons suspected of having committed an offence of enforced disappearance are not in a position to influence the progress of an investigation by means of pressure or acts of intimidation or reprisal aimed at the complainant, witnesses, relatives of the disappeared person or their defence counsel, or at persons participating in the investigation.
وتتأكد بوجه خاص من أنه ليس بوسع المتهمين بارتكاب جريمة الاختفاء القسري التأثير على مجرى التحقيق بممارسة ضغوط أو بتنفيذ أعمال ترهيب أو انتقام على الشاكي أو الشهود أو أقارب الشخص المختفي والمدافعين عنهم فضلاً عن المشتركين في التحقيق.

It was further stated that wire—tapping of suspects or persons charged with a crime and records of their telephone conversations were undertaken only on the basis of a reasoned decision by an examining officer or investigator and with the approval of the president of a court.
وذكر أيضا أن التنصت الهاتفي على المشتبه فيهم أو على اﻷشخاص المتهمين بارتكاب جريمة وتسجيل مكالماتهم الهاتفية يتمان فقط على أساس قرار صائب يتخذه الضابط المحقق أو المحقق وبموافقة رئيس المحكمة.

Legal aid is provided automatically to all persons suspected of a crime.
وتقدَّم المساعدة القانونية تلقائياً لجميع الأشخاص المتهمين بارتكاب جريمة.

She calls on all concerned States to cooperate fully with the International Criminal Tribunal for the Former Yugoslavia and the International Criminal Tribunal for Rwanda, particularly by arresting and handing over suspects with a view to prosecuting those accused of the crime of genocide.
وتدعو جميع الدول المعنية إلى التعاون تعاوناً تاماً مع المحكمة الجنائية الدولية ليوغوسلافيا السابقة والمحكمة الجنائية الدولية لرواندا، وخاصة عن طريق القبض على المشتبه فيهم وتسليمهم، بغية تقديم المتهمين بارتكاب جريمة الإبادة الجماعية إلى العدالة.

(i) To ensure that persons detained, arrested, suspected or accused of, or charged with a criminal offence are advised of their rights and the implications of waiving them in a clear and plain manner; and endeavour to ensure that the person understands both;
(ط) ضمان إطلاع الأشخاص المحتجزين أو المقبوض عليهم أو المشتبه بهم أو المتهمين بارتكاب جريمة بحقوقهم وآثار تنازلهم عنها بأسلوب واضح لا لبس فيه؛ والحرص على التأكد من فهم الشخص المعني لكلا الأمرين؛

(a) To ensure that police and judicial authorities do not arbitrarily restrict the right or access to legal aid for persons detained, arrested, suspected or accused of, or charged with a criminal offence, in particular in police stations;
(أ) ضمان ألاّ تقوم الشرطة أو السلطات القضائية تعسفاً بتقييد حق الأشخاص المحتجزين أو المقبوض عليهم أو المشتبه بهم أو المتهمين بارتكاب جريمة في الحصول على المساعدة القانونية أو تقييد حصولهم عليها، وخصوصاً في مراكز الشرطة؛

(b) Enabling children who are detained, arrested, suspected or accused of, or charged with a criminal offence to contact their parents or guardians at once and prohibiting any interviewing of a child in the absence of his or her lawyer or other legal aid provider, and parent or guardian when available, in the best interests of the child;
(ب) تمكين الأطفال المحتجزين أو المقبوض عليهم أو المشتبهين أو المتهمين بارتكاب جريمة من الاتصال بوالديهم أو أوصيائهم فوراً، وحظر إجراء أيِّ استجواب للطفل في غياب محاميه أو مقدِّم المساعدة القانونية المكلف به وأحد والديه أو وصيّه، إن وجد، بما يخدم مصالح الطفل الفضلى؛

(a) To ensure and promote the provision of effective legal aid at all stages of the criminal justice process for persons detained, arrested or imprisoned, suspected or accused of, or charged with a criminal offence and for victims of crime;
(أ) ضمان وتشجيع تقديم المساعدة القانونية الفعالة في جميع مراحل إجراءات العدالة الجنائية إلى الأشخاص المحتجزين أو المقبوض عليهم أو المسجونين أو المشتبه بهم أو المتهمين بارتكاب جريمة وضحايا هذه الجريمة؛

(b) Enabling children who are detained, arrested, suspected or accused of, or charged with a criminal offence to contact their parents or guardians at once and prohibiting any interviewing of a child in the absence of his or her lawyer or other legal aid provider, and parent or guardian when available, in the best interests of the child;

(e) To enable paralegals to provide those forms of legal aid allowed by national law or practice to persons arrested, detained, suspected of or charged with a criminal offence, in particular in police stations or other detention centres;
(ﻫ) تمكين المساعدين القانونيين من تقديم هذه الأشكال من المساعدة القانونية التي يجيزها القانون الوطني أو الممارسة الوطنية لصالح الأشخاص المقبوض عليهم أو المحتجزين أو المشتبه بارتكابهم جريمة أو المتهمين بارتكاب جريمة وخصوصاً في مراكز الشرطة أو غيرها من مراكز الاحتجاز؛

It shall ensure in particular that persons suspected of having committed an offence of enforced disappearance are not in a position to influence the progress of an investigation by means of pressure or acts of intimidation or reprisal aimed at the complainant, witnesses, relatives of the disappeared person or their defence counsel, or at persons participating in the investigation.
وتتأكد بوجه خاص من أنه ليس بوسع المتهمين بارتكاب جريمة الاختفاء القسري التأثير على مجرى التحقيق بضغوط أو بتنفيذ أعمال ترهيب أو انتقام تُمارَس على الشاكي أو الشهود أو أقارب الشخص المختفي والمدافعين عنهم، فضلاً عن المشتركين في التحقيق.

(11) The Committee remains concerned at the use of long-term solitary confinement during pretrial detention, and in particular at the possibility of unlimited prolongation of such a measure with regard to persons charged with a crime under parts 12 and 13 of the Criminal Code, including persons under 18 years of age (arts. 7, 9 and 10).
11) ولا تزال اللجنة قلقة إزاء استخدام الحبس الانفرادي لمدة طويلة خلال الاحتجاز قبل المحاكمة، وبوجه خاص، إزاء احتمال تمديد هذا الإجراء إلى ما لا نهاية فيما يتعلق بالأشخاص المتهمين بارتكاب جريمة تندرج في الجزأين 12 و13 من القانون الجنائي، بمن في ذلك الأشخاص دون سن 18 عاماً (المواد 7 و9 و10).

In addition, the State must, if the situation so required, assign a lawyer to assist a person suspected of a crime or assist the presumed victims.
وباﻹضافة إلى ذلك فإنه يجب على الدولة، إذا تطلبت الحالة، تعيين محام لمساعدة اﻷشخاص المتهمين بارتكاب جريمة أو مساعدة اﻷشخاص المفترض أنهم ضحايا.

She urges the international community and all concerned States to cooperate fully with the International Criminal Tribunal for the Former Yugoslavia and the International Tribunal for Rwanda, particularly by arresting and handing over suspects, so as to bring to justice as soon as possible those accused of the crime of genocide.
وهي تحث المجتمع الدولي وجميع الدول المعنية، على التعاون الكامل مع المحكمة الجنائية الدولية ليوغوسلافيا السابقة والمحكمة الجنائية لرواندا، وخاصة عن طريق القبض على المشتبه فيهم وتسليمهم، بغية تقديم المتهمين بارتكاب جريمة الإبادة الجماعية الى العدالة في أسرع وقت ممكن.

Respect for the right of all persons to a hearing, to due process and to legal safeguards requires the proper observance of extradition treaties and recognition of them as the sole mechanism for handing persons accused of committing an offence over to foreign courts.
وأن احترام الضمانات المتعلقة بالاستماع الى أقوال المتهمين وبالشرعية وباﻷمن القضائي الذي يعتبر من حق جميع اﻷفراد يرغم على التقيد الواجب بمعاهدات تسليم المجرمين والاعتراف بها بوصفها اﻵلية الوحيدة لتسليم اﻷفراد المتهمين بارتكاب جريمة الى المحاكم الواقعة خارج الحدود.

Noting that, fifty years after inclusion of a proposal to that effect, concrete steps have been taken to create international penal tribunals with jurisdiction over persons charged with genocide,
وإذ تلاحظ أنه، بعد انقضاء خمسين عاما على تقديم الاقتراح الداعي إلى إنشاء محاكم جنائية دولية تكون لها الولاية على اﻷشخاص المتهمين بارتكاب جريمة اﻹبادة الجماعية، تم اتخاذ خطوات ملموسة في هذا الصدد،

Help to ensure the defence of the alleged perpetrators of the genocide with a view to securing equitable justice.
أن تساهم في تأمين محامين لﻷشخاص المتهمين بارتكاب جريمة اﻹبادة الجماعية بغية توفير محاكمة عادلة لهم.
