In particular, his delegation welcomed the reference to paragraph 28 of General Assembly resolution 63/253, which affirmed that the Dispute Tribunal and the Appeals Tribunal should not have any powers beyond those conferred under their respective statutes.

In this regard, delegations reaffirmed that, in accordance with paragraph 28 of General Assembly resolution 63/253, the Dispute Tribunal and the Appeals Tribunal shall not have any powers beyond those conferred under their respective statutes (see General Assembly resolution 66/237, paragraph 9).

208. The General Assembly, in paragraph 28 of its resolution 63/253, affirmed that " the United Nations Dispute Tribunal and the United Nations Appeals Tribunal shall not have any powers beyond those conferred under their respective statutes " .
208 - تؤكد الجمعية العامة في الفقرة 28 من قرارها 63/253 أن " محكمة الأمم المتحدة للمنازعات ومحكمة الأمم المتحدة للاستئناف لن تتمتعا بأي صلاحيات تتجاوز الصلاحيات المخولة إليهما بموجب النظام الأساسي لكل منهما " .

9. With regard to the award of exemplary and punitive damages, delegations had recalled the General Assembly's decision that the Tribunals should not have any powers beyond those conferred under their respective statutes and had supported the Secretary-General's recommendation that further reporting on the issue should be requested for consideration at the sixty-eighth session of the General Assembly.
9 - وفيما يتعلق بمسألة دفع التعويضات الرادعة أو الزجرية قال إن الوفود أوعزت إلى قرار الجمعية العامة بألا يكون للمحكمتين أي سلطات تتجاوز الصلاحيات المخولة إليهما بموجب النظام الأساسي لكل منهما، وأيدت توصية الأمين العام بأن تطلب الجمعية العامة تقريراً آخر عن هذه المسألة لنظره في دورتها الثامنة والستين.

Procedural issues such as contempt of court and dealing with the source of perjured evidence, which would often be deterred by potential criminal sanctions in national courts, are addressed by the Tribunals under " abuse of proceedings " because of their interpretation of resolution 66/237, in which the General Assembly stated that the Tribunals had no powers beyond those conferred under their respective statutes.
وستنظر المحكمتان في المسائل الإجرائية من قبيل انتهاك حرمة المحكمة والتعامل مع مصدر شهادة الزور، التي عادة ما تردعها المحاكم الوطنية بتطبيق عقوبات جنائية محتملة، في إطار فئة " إساءة استخدام الإجراءات " نظرا لتفسيرهما للقرار 66/237، الذي نصّت الجمعية العامة فيه على أن المحكمتين لا تملكان أية صلاحيات عدا تلك المخولة إليهما بموجب نظاميهما الأساسيين().
