Upon being satisfied that the circumstances so warrant, the State Party in whose territory the alleged offender is present shall take the appropriate measures under its domestic law to ensure his or her presence for the purpose of prosecution and extradition.
تتخذ الدولة الطرف التي يوجد المدعى عليه بارتكاب الجريمة في أراضيها التدابير المناسبة بموجب قانونها المحلي لكفالة وجوده لغرض المحاكمة والتسليم، لدى اطمئنانها إلى أن الظروف تقتضي ذلك.

The State Party in whose territory the alleged offender is present shall, if it does not extradite him or her, submit, without exception whatsoever and without undue delay, the case to its competent authorities, for the purpose of prosecution, through proceedings in accordance with domestic law.
تقوم الدولة الطرف التي يكون المدعى عليه بارتكاب الجريمة موجودا في أراضيها، إذا لم تقم بتسليمه، بعرض القضية على سلطاتها المختصة بغرض تقديمه للمحاكمة، من خلال اﻹجراءات المتفقة مع القانون المحلي، دون أي استثناء على اﻹطلاق ودون إبطاء ليس له ما يُبرره.

(b) When the alleged offender is a national of that State;
)ب( عندما يكون المدعى عليه بارتكاب الجريمة أحد مواطني تلك الدولة؛

(c) When the alleged offender is present in its territory and it does not extradite him or her.
)ج( عندما يكون المدعى عليه بارتكاب الجريمة موجودا في أراضي تلك الدولة ولا تقوم بتسليمه.

(b) The State of which the alleged offender is a national or, if he or she is a stateless person, in whose territory he or she permanently resides.
)ب( الدولة التي يكون المدعى عليه بارتكاب الجريمة أحد مواطنيها أو مقيما بصفة دائمة في أراضيها إذا كان عديم الجنسية.
