Judicial authority was exercised by legal scholars, religious scholars and legal professionals that had defected from the Government and applied a hybrid of Islamic and Syrian Civil law.
ويمارس السلطة القضائية فقهاء قانونيون وعلماء دين وممارسو مهنة القانون ممن انشقوا عن الحكومة، ويُطبق هؤلاء طائفة واسعة جداً من أحكام الشريعة الإسلامية والقانون المدني السوري.

Under article 25 of the Syrian Civil Code, pre-existing or other articles of law that conflict with an international treaty in force in the Syrian Arab Republic are inapplicable.
كما نصَّت المادة 25 من القانون المدني السوري على عدم سريان أحكام المواد السابقة أو المخالفة لمعاهدة دولية نافذة في سورية.

Since article 25 of the Syrian Civil Code gave precedence to international agreements over national laws, the Commission had prepared a training programme for Syrian courts on utilization of the Convention as a national tool.
ونظراً لأن المادة 25 من القانون المدني السوري تعتبر الاتفاقيات الدولية مقدمة على القوانين السورية المرعية، فقد أعدت الهيئة برنامجاً تدريبياً للمحاكم السورية عن استخدام الاتفاقية كأداة وطنية.

This principle is embodied in article 40 of the Syrian Civil Code, which states: " Everyone must have a name and a family name to pass on to his children. "
وهذا ما تؤكده المادة 40 من القانون المدني السوري حيث نصت على: " يكون لكل شخص اسم ولقب شخصي يلحق أولاده " .

1. Legislative Decree No. 84 of 28 May 1949, i.e., the Syrian Civil Code, articles 54 and 55 of which define artificial persons and the rights enjoyed by them.
أ - المرسوم التشريعي رقم 84 المؤرخ 28 أيار/مايو 1949 أي القانون المدني السوري. ب - المرسوم التشريعي رقم 199 المؤرخ 8 نيسان/أبريل 1952 المتعلق بنظام الرياضة.

This is confirmed by article 25 of the Syrian Civil Code, which stipulates that: " The provisions of the preceding articles shall apply only in the absence of a conflicting text or international convention in force in Syria " .
حيث أكدت المادة 25 من القانون المدني السوري على ذلك. حين نصت على أنه " لا تسري أحكام السابقة إلا حيث لا يوجد نص على خلاف ذلك أو معاهدة دولية نافذة في سورية " .

The legal principles in force in Syria apply to all citizens without distinction, as affirmed in article 1 of the Syrian Civil Code which stipulates that: " The provisions of the law shall apply to all matters to which they refer in letter or in spirit. "
274- وتسري المبادئ القانونية النافذة في سورية على جميع المواطنين دون تمييز حيث أكدت المادة الأولى من القانون المدني السوري على ذلك حين نصت على أن: " تسري النصوص التشريعية على جميع المسائل التي تتناولها هذه النصوص في لفظها أو فحواها " .

59. Ratification of this Convention is like enacting a domestic law, as affirmed in article 25 of the Syrian Civil Code and article 27 of the Vienna Convention on the Law of Treaties, to which Syria has acceded. This principle was recognized by the Syrian Court of Cassation in ruling No. 1905 of 12 December 1980.
59- إن تصديق هذه الاتفاقية يعد بمثابة تشريع وطني وهذا ما تؤكده المادة 25 من القانون المدني السوري والمادة 27 من اتفاقية فيينا المتضمنة قانون المعاهدات الدولية التي انضمت إليها سورية، وهذا ما استقر عليه اجتهاد محكمة النقض السورية رقم 1905 بتاريخ 12 كانون الأول/ديسمبر 1980.
