It was noted that, if a secured creditor sold or licensed an encumbered intellectual property right in a judicial or other officially supervised process, rights acquired by a transferee or licensee would be regulated by the relevant law applicable to the enforcement of court judgements.
72- لوحظ أنه، إذا ما باع دائن مضمون حق ملكية فكرية مرهون أو رخّص به في دعوى قضائية أو أي إجراء آخر يخضع لإشراف رسمي، خضعت الحقوق التي يكتسبها المنقول إليه أو المرخّص له للقانون ذي الصلة المنطبق على إنفاذ الأحكام القضائية.

It was agreed that a new recommendation could be included in the draft guide to address the consequences of failure of the secured creditor to comply with any of its obligations under the provisions of the law governing default and enforcement on the rights of a good-faith buyer, lessee or licensee of an encumbered asset.
77- اتفق على أنه يمكن إدراج توصية جديدة في مشروع الدليل لمعالجة تبعات عدم امتثال الدائن المضمون لأي من التزاماته بموجب أحكام القانون التي تنظّم التقصير والإنفاذ فيما يتعلق بحقوق مشتري الموجودات المرهونة أو مستأجرها أو المرخّص له فيها ذي النية الحسنة.
