٤١- كما تلاحظ اللجنة مع القلق اعتماد " المرسوم الرئاسي المتعلق بأنشطة المحامين وموثقي العقود " المؤرخ ٣ أيار/مايو ٧٩٩١ الذي يمنح وزارة العدل اختصاص الترخيص للمحامين وإجبارهم، لكي يتمكنوا من ممارسة وظيفتهم، على أن يصبحوا أعضاء في هيئة جماعية مركزية تسيطر عليها الوزارة، مما يقوض استقلالية المحامين.

١٥٠ - كما تلاحظ اللجنة بقلق اعتماد المرسوم الرئاسي المتعلق بأنشطة المحامين والموثقين الصادر في ٣ أيار/ مايو ١٩٩٧، الذي يمنح وزارة العدل صلاحية الترخيص للمحامين ويلزمهم، لكي يتمكنوا من ممارسة المهنة، بالحصول على عضوية مجمع زمالة مركزي تسيطر عليه الوزارة، اﻷمر الذي يقوض استقلال المحامين.

In this context, and after consultations among the country's legalized and recognized political parties, a Presidential Decree on voter registration was promulgated on 14 August 2002 with a view to holding presidential elections during the first half of 2003, in accordance with the applicable legislation.

8. The Government is stepping up its efforts to fully implement the Nuclear Security Recommendations on Physical Protection of Nuclear Material and Nuclear Facilities (INFCIRC/225/Rev.5) of the International Atomic Energy Agency (IAEA) and is taking the necessary steps to amend the Presidential Decree relating to the Act on Physical Protection and Radiological Emergency to reflect those recommendations.
8 - وتكثف حكومة جمهورية كوريا جهودها من أجل التنفيذ الكامل لتوصيات الأمن النووي المتعلقة بالحماية المادية للمواد والمنشآت النووية (INFCIRC/225/Rev.5) الصادرة عن الوكالة الدولية للطاقة الذرية، وهي تتخذ الخطوات اللازمة لتعديل المرسوم الرئاسي المتعلق بقانون الحماية المادية والطوارئ الإشعاعية بحيث يعكس هذه التوصيات.

The State party has not addressed these claims specifically considering these provisions of the Covenant, but has explained that the author's licence was not issued because, by having his administrative liability engaged for participation in an unauthorized meeting in violation of a Presidential Decree on Mass Actions, he had breached his duties as a lawyer set out in the Law on Lawyers.
ولم تتناول الدولة الطرف هذه الادعاءات واضعة أحكام العهد هذه تحديداً في الاعتبار، ولكنها أوضحت أن صاحب البلاغ لم يحصل على الترخيص لأنه يكون بثبوت مسؤوليته الإدارية عن المشاركة في تجمع غير مأذون به قد خرق المرسوم الرئاسي المتعلق بالأنشطة الجماهيرية، وأخل بذلك بما يفرضه عليه قانون المحاماة من واجبات كمحام.
