39. The Working Group reminds the Government of Algeria of its obligations under article 13 of the Declaration, that steps shall be taken to ensure that all involved in the investigation are protected against ill-treatment, intimidation or reprisal.
39- ويذكِّر الفريق العامل حكومة الجزائر بالتزاماتها بموجب المادة 13 من الإعلان التي تقضي باتخاذ خطوات لضمان حماية جميع الأشخاص المشاركين في التحقيق من سوء المعاملة أو التهديد أو الأعمال الانتقامية.

It shall ensure in particular that persons suspected of having committed an offence of enforced disappearance are not in a position to influence the progress of the investigations by means of pressure or acts of intimidation or reprisal aimed at the complainant, witnesses, relatives of the disappeared person or their defence counsel, or at persons participating in the investigation.
فتتأكد خاصة من أن الأشخاص المشتبه في أنهم ارتكبوا جريمة اختفاء قسري لا يستطيعون التأثير على سير التحقيقات عن طريق ممارسة الضغوط وأعمال التخويف أو الانتقام من الشاكي، أو الشهود، أو ذوي الشخص المختفي والمدافعين عنهم فضلاً عن المشاركين في التحقيق.

6. (a) Medical experts involved in the investigation of torture or ill-treatment should behave at all times in conformity with the highest ethical standards and in particular shall obtain informed consent before any examination is undertaken.
6- (أ) ينبغي للخبراء الطبيين المشاركين في التحقيق في التعذيب أو إساءة المعاملة أن يتصرفوا في جميع الأوقات وفقاً لأعلى المعايير الأخلاقية وأن يحصلوا بخاصة على الموافقة عن علم قبل إجراء أي فحص.

With regard to the reply of 27 March 2013, the Working Group stresses that all involved in the investigation of cases of enforced disappearances should be protected regardless of whether there is a complaint or not.
وفيما يخص الرد المؤرخ 27 آذار/مارس 2013، يشدد الفريق العامل على ضرورة حماية جميع المشاركين في التحقيق في حالات الاختفاء القسري بصرف النظر عما إذا كانت توجد شكوى أم لا.

6. (a) Medical experts involved in the investigation of torture or ill-treatment shall behave at all times in conformity with the highest ethical standards and in particular shall obtain informed consent before any examination is undertaken.
6 - (أ) ينبغي للخبراء الطبيين المشاركين في التحقيق في التعذيب أو إساءة المعاملة أن يتصرفوا في جميع الأوقات وفقا لأعلى المعايير الأخلاقية وأن يحصلوا بخاصة على الموافقة عن علم قبل إجراء أي فحص.

5. Each State Party shall take steps to ensure that all persons involved in the investigation — including the complainant, the relatives of the disappeared person, legal counsel, witnesses and those conducting the investigation — are protected against ill—treatment and any acts of intimidation or reprisal as a result of the complaint or investigation.
٥- على كل دولة طرف أن تتخذ اﻹجراءات التي تكفل لجميع المشاركين في التحقيق - بمن فيهم الشاكي وأهل الشخص المختفي ومحاميه والشهود والمحققون - الحماية من سوء المعاملة ومن أي فعل من أفعال التخويف أو الانتقام نتيجة للشكوى أو للتحقيق.

It further wishes to remind the Government of its responsibility to " ensure that all involved in the investigation are protected against illtreatment, intimidation or reprisal " , in accordance with article 13 (3) of the Declaration.

425. 122. More particularly, it should be made clear that the Code of Criminal Investigation provides for a number of measures for the protection of persons involved in the investigation (arts. 75 bis, 86 bis, 102 et seq.).

While thanking the Government for its responses to two of the communications, the Working Group recalls article 13, paragraph 3, of the Declaration, which provides that steps shall be taken to ensure that all involved in the investigation of an enforced disappearance, including the complainant, counsel, witnesses and those conducting the investigation, are protected against ill-treatment, intimidation or reprisal.

3.2 The person submitting the request may also ask that measures be taken to protect the complainant, witnesses, relatives of the disappeared person and their defence counsel, as well as persons participating in the investigation.
3-2 يجوز لمقدم الطلب أيضاً أن يطلب اعتماد تدابير حماية لصالح المبلّغ والشهود وذوي الشخص المختفي والمدافعين عنهم وكذلك المشاركين في التحقيق.

4.2 An author may, at any stage of the process, also request the adoption of protection measures on behalf of the complainant, witnesses, relatives of the disappeared person and their defence counsel, as well as persons participating in the investigation.
4-2 ولمقدم البلاغ أيضاً أن يطلب، في أي مرحلة من مراحل الإجراء، اعتماد تدابير حماية لصالح المتظلم، والشهود، وذوي الشخص المختفي، ومحاميه، وكذلك المشاركين في التحقيق وفقاً للمادة 18 من الاتفاقية.
