94. The principal guarantees established by Tunisian law for the benefit of those suspected of having committed a crime of enforced disappearance or any other offence are set out in the following paragraphs.
94- فيما يلي استعراض لأبرز الضمانات التي يُقرّها القانون التونسي لفائدة المشتبه بارتكابهم جريمة الاختفاء القسري وغيرها من الجرائم.

The Committee is also concerned at reports that many children lacking parental care, in particular abandoned children, are apprehended and placed in the same closed facilities as children suspected or accused of criminal wrongdoing.
كما تعرب اللجنة عن قلقها إزاء التقارير التي وردتها بشأن العدد الكبير من الأطفال المحرومين من رعاية الوالدين، وبخاصة الأطفال المهملون، والذين يتعرضون للاعتقال والإيداع في نفس المرافق المغلقة إلى جانب الأطفال المشتبه بارتكابهم جريمة جنائية أو المتهمين بذلك.

62 - وينبغي أن تغطي ميزانية المساعدة القانونية المجموعة الكاملة من الخدمات المقرَّر تقديمها للأشخاص المحتجزين، أو المقبوض عليهم أو السجناء، أو المشتبه بارتكابهم جريمة أو المتهمين بارتكاب جريمة، وللضحايا كذلك.

(f) To request bar or legal associations and other partnership institutions to establish a roster of lawyers and paralegals to support a comprehensive legal system for persons detained, arrested, suspected or accused of, or charged with a criminal offence, in particular at police stations;
(و) دعوة نقابات المحامين أو الرابطات القانونية والمؤسسات الشريكة الأخرى إلى وضع قائمة بأسماء المحامين والمساعدين القانونيين من أجل دعم وجود نظام قانوني شامل للمحتجزين أو المقبوض عليهم أو المشتبه بارتكابهم جريمة أو المتهمين بارتكاب جريمة، وخصوصا في مراكز الشرطة؛

(f) To request bar or legal associations and other partnership institutions to establish a roster of lawyers and paralegals to support a comprehensive legal system for persons detained, arrested, suspected or accused of, or charged with a criminal offence, in particular at police stations;
(و) دعوة نقابات المحامين أو الرابطات القانونية والمؤسسات الشريكة الأخرى إلى وضع قائمة بأسماء المحامين والمساعدين القانونيين من أجل دعم نظام قانوني شامل للمحتجزين أو المقبوض عليهم أو المشتبه بارتكابهم جريمة أو المتهمين بارتكاب جريمة، وخصوصاً في مراكز الشرطة؛

(i) To ensure that persons detained, arrested, suspected or accused of, or charged with a criminal offence are advised of their rights and the implications of waiving them in a clear and plain manner; and endeavour to ensure that the person understands both;
(ط) ضمان إطلاع الأشخاص المحتجزين أو المقبوض عليهم أو المشتبه بارتكابهم جريمة أو المتهمين بارتكابها بحقوقهم وآثار تنازلهم عنها بأسلوب واضح لا لبس فيه؛ والحرص على التأكد من فهم الشخص المعني لكلا الأمرين؛

(a) To ensure that police and judicial authorities do not arbitrarily restrict the right or access to legal aid for persons detained, arrested, suspected or accused of, or charged with a criminal offence, in particular in police stations;
(أ) ضمان ألاّ تقوم الشرطة أو السلطات القضائية تعسفاً بتقييد حق الأشخاص المحتجزين أو المقبوض عليهم أو المشتبه بارتكابهم جريمة أو المتهمين بارتكابها في الحصول على المساعدة القانونية أو تقييد حصولهم عليها، وخصوصاً في مراكز الشرطة؛

(b) Enabling children who are detained, arrested, suspected or accused of, or charged with a criminal offence to contact their parents or guardians at once and prohibiting any interviewing of a child in the absence of his or her lawyer or other legal aid provider, and parent or guardian when available, in the best interests of the child;
(ب) تمكين الأطفال المحتجزين أو المقبوض عليهم أو المشتبه بارتكابهم جريمة أو المتهمين بارتكاب جريمة من الاتصال بوالديهم أو أوصيائهم فوراً، وحظر إجراء أيِّ استجواب للطفل في غياب محاميه أو مقدِّم المساعدة القانونية المكلف به وأحد والديه أو وصيّه، إن وجد، بما يخدم مصالح الطفل الفضلى؛
