Appropriate steps shall be taken, where necessary, to ensure that the complainant, witnesses, relatives of the disappeared person and their defence counsel, as well as persons participating in the investigation, are protected against all illtreatment or intimidation as a consequence of the complaint or any evidence given.
وتتخذ تدابير ملائمة عند الاقتضاء لضمان حماية الشاكي والشهود وأقارب الشخص المختفي والمدافعين عنهم فضلاً عن المشتركين في التحقيق من أي سوء معاملة أو ترهيب بسبب الشكوى المقدمة أو أية شهادة مدلى بها.

It shall ensure in particular that persons suspected of having committed an offence of enforced disappearance are not in a position to influence the progress of an investigation by means of pressure or acts of intimidation or reprisal aimed at the complainant, witnesses, relatives of the disappeared person or their defence counsel, or at persons participating in the investigation.
وتتأكد بوجه خاص من أنه ليس بوسع المتهمين بارتكاب جريمة الاختفاء القسري التأثير على مجرى التحقيق بممارسة ضغوط أو بتنفيذ أعمال ترهيب أو انتقام على الشاكي أو الشهود أو أقارب الشخص المختفي والمدافعين عنهم فضلاً عن المشتركين في التحقيق.

2. Appropriate measures shall be taken, where necessary, to protect the persons referred to in paragraph 1, as well as persons participating in the investigation, from any ill-treatment, intimidation or sanction as a result of the search for information concerning a person deprived of liberty.
2- تتخذ تدابير ملائمة عند الاقتضاء لتأمين حماية الأشخاص المشار إليهم في الفقرة 1 من هذه المادة فضلاً عن الأشخاص المشتركين في التحقيق من كل سوء معاملة أو تخويف أو عقاب بسبب البحث عن معلومات عن شخص محروم من حريته.

وتتأكد بوجه خاص من أنه ليس بوسع المتهمين بارتكاب جريمة الاختفاء القسري التأثير على مجرى التحقيق بضغوط أو بتنفيذ أعمال ترهيب أو انتقام تمارس على الشاكي أو الشهود أو أقارب الشخص المختفي والمدافعين عنهم، فضلاً عن المشتركين في التحقيق " .

The Committee nevertheless remains concerned about the fact that these provisions are not in full conformity with article 12, paragraph 1, of the Convention, which in addition specifically requires that " relatives of the disappeared person and their defence counsel, as well as persons participating in the investigation, are protected against all ill-treatment or intimidation as a consequence of the complaint or any evidence given " (art. 12).
وتظل اللجنة مع ذلك قلقة لأن هذه الأحكام ليست متسقة تماماً مع أحكام الفقرة 1 من المادة 12 من الاتفاقية التي تشترط أيضاً توفير حماية خاصة ل " أقارب الشخص المختفي والمدافعين عنهم فضلاً عن المشتركين في التحقيق من أي سوء معاملة أو ترهيب بسبب الشكوى المقدمة أو أية شهادة يدلى بها " (المادة 12).

9. Please provide detailed information on the mechanisms for protecting complainants, witnesses, relatives of the disappeared person and their defence counsel, as well as persons participating in the investigation of a disappearance, against all ill-treatment or intimidation as a consequence of the complaint or any evidence given (art. 12).
9- ويرجى تقديم معلومات مفصلة عن الآليات القائمة لحماية المشتكين والشهود وأقارب الشخص المختفي والمدافعين عنه، فضلاً عن المشتركين في التحقيق في اختفاء قسري ما، ضد جميع أشكال الاعتداء أو الترهيب التي قد يتعرضون لها من جراء تقديم الشكوى أو من جراء الإدلاء بأي تصريح (المادة 12).
