A second claim, on behalf of its Ministry of Energy, is for expenses of cleaning and restoring electrical installations affected by airborne pollutants, losses arising from reduced energy sales, costs of materials and equipment damaged or destroyed by the airborne pollutants, and other losses.

As to the second claim described in paragraph , the Panel notes that, given the reasonable estimate of the duration of passage between Los Angeles and Kuwait, the goods would not have arrived in Kuwait by 2 August 1990 and therefore could not have been lost as a direct result of Iraq's invasion and occupation of Kuwait.

In the second claim, the claimant asserted the loss of 76 items or sets of jewellery purchased from a renowned jeweller in Kuwait and from Asprey, David Morris, H. Stern and Tiffany & Co. (collectively, the " Valuation Items " ).

The claimant in the second claim documented his ownership of the Asprey and David Morris jewellery items by providing detailed statements from each supplier describing the items and confirming purchase dates and prices for all of the items, as well as copies of original, pre-invasion purchase records for the majority of the jewellery items.
41- وقدم صاحب المطالبة الثانية إثباتاً لملكيته للمجوهرات من صنع أسبري ودافيد موريس بيانات مفصلة من كل مورِّد منهما يصف فيها المجوهرات ويؤكد فيها على تواريخ وأسعار شراء جميع القطع، وكذلك نسخاً عن سجلات أصلية تؤكد شراء غالبية المجوهرات قبل الغزو.

It would have been appropriate to state, either in the draft articles on State responsibility or in those relating to diplomatic protection, the fundamental principle that the amount of the second claim should form the basis -- or, rather, the measure -- of the first, thus ensuring that the claim by the State of nationality of the injured person did not constitute a new claim against the State against which protection was being sought.

claim II seeks compensation in the amount of 16,688 deutsche mark for the cost of overnight accommodation in Frankfurt and airfares from Frankfurt to their home cities in Australia for three Australian hostages evacuated from Baghdad to Germany by a third State.
٢٤- وهو يطلب في المطالبة الثانية تعويضا بمبلغ ٨٨٦ ٦١ ماركاً ألمانياً عن كلفة مبيت ليلة في فرانكفورت لثلاثة رهائن أستراليين تم إجلاؤهم من بغداد إلى ألمانيا بواسطة دولة ثالثة، وعن أجور سفرهم جواً من فرانكفورت إلى مدنهم في أستراليا.

The other claim did not contain the claimant's affirmation concerning the losses claimed although the claimant was given an opportunity to remedy this formal deficiency.
