٠١- ثمّ إن أربعة من المطالبين الذين طُلب إليهم تقديم معلومات إضافية قد التمسوا من الفريق أن يمدد لهم الفترة الزمنية المحددة في القرار اﻹجرائي لتقديم ردودهم.

The Panel noted that all claimants who did not submit such annual accounts provided sufficient explanations; for example, where the claimant had commenced trading in the period from 1987 to 1990 or where the claimant had ceased trading following Iraq's invasion and occupation of Kuwait.

claimants who indicated that they left Iraq or Kuwait in their own vehicles may have their losses considered to be causally linked to the invasion if the vehicles were left in a country known to have been a formal or informal point of departure from the region.
وفي حالة المطالبين الذين ذكروا أنهم غادروا العراق أو الكويت في سياراتهم الخاصة، يمكن اعتبار خسائرهم مرتبطة بالغزو برابطة السببية إذا كانت السيارة قد تركت في بلد من المعروف أنه كان يعتبر، بصفة رسمية أو غير رسمية، من نقاط الرحيل من المنطقة(198).

However, the Panel also found that claimants who were employed in locations other than in Iraq or Kuwait could not benefit from the same presumption.
بيد أن الفريق تبين أيضاً أن المطالبين الذين كانوا مستخدمين في مواقع أخرى خارج العراق أو الكويت يمكن أن يصدق عليهم هذا الافتراض نفسه(234).

In its review of the claims in the first instalment, the Panel was particularly concerned that the interests of the claimants, who fled a war zone in haste and were therefore often unable to take documentary evidence with them, be balanced with the need to demonstrate that the claimed losses were caused as a direct result of the invasion and occupation of Kuwait.
٥٣- ولدى قيام الفريق باستعراض مطالبات الدفعة اﻷولى، كان حريصاً بوجه خاص على الموازنة بين مصالح المطالبين الذين فروا من منطقة القتال بصورة عاجلة ولم يتمكنوا بالتالي في أحيان كثيرة من اصطحاب أدلة مستندية معهم، وبين ضرورة إثبات أن الخسائر موضوع المطالبة قد نتجت مباشرة عن غزو واحتلال الكويت.

In view of these results, the Panel found it reasonable to presume that those claimants who were resident in Iraq or Kuwait and who left during the traditional vacation months of June or July 1990 would have returned to those countries had Iraq not invaded Kuwait.
٤٢- وفي ضوء هذه النتائج، رأى الفريق أن من المعقول افتراض أن هؤلاء المطالبين الذين كانوا مقيمين في العراق أو في الكويت والذين غادروا البلدين خلال فترة العطلة العادية في شهري حزيران/يونيه وتموز/يوليه ٠٩٩١ كانوا سيعودون إلى البلدين المذكورين لولا غزو العراق للكويت.

The Panel determined that those claimants who failed to establish the fact of residence in Iraq or Kuwait or the fact of direct interference with an employment relationship outside Iraq or Kuwait by the Iraqi invasion and occupation of Kuwait are not eligible for compensation for C6-Salary losses.
٥٣- ورأى الفريق أن المطالبين الذين قصروا عن إثبات واقعة اقامتهم في العراق أو في الكويت أو واقعة تدخل غزو العراق واحتلاله للكويت تدخلاً مباشراً في علاقة عملهم خارج العراق أو الكويت، ليسوا مؤهلين للحصول على التعويض في إطار الفئة جيم/٦ المتعلقة بالخسائر من المرتبات.

(c) After the twelve-month period, referred to in paragraph (b) above, any undistributed funds will not be held in reserve for payment to those claimants who have not been located for payment.
