When asked about the witness statement he provided in which the non-Kuwaiti claimant extensively referred to himself as the manager of the Kuwaiti claimant's business, the Kuwaiti claimant stated that he had not reviewed the witness statement closely before including it in his claim.
وعندما سُئل عن الشهادة التي قدَّمها والتي يشير فيها المطالب غير الكويتي إلى نفسه إشارات ضافية إلى أنه مدير شركة المطالب الكويتي، أفاد المطالب الكويتي أنه لم يستعرض الشهادة عن كثب قبل إدراجها في مطالبته.

After a thorough review of the evidence, the Panel determines that the Kuwaiti claimant has not provided a satisfactory explanation for the various evidentiary inconsistencies and finds that the Kuwaiti claimant is only entitled to compensation for any non-duplicative losses claimed.
41- وبعد استعراضٍ مستفيضٍ للأدلة، يخلص الفريق إلى أنّ المطالب الكويتي لم يُقدِّم تفسيرًا مقنعًا للتناقضات المختلفة في الأدلة المقدمة، ويخلص إلى أنّ المطالب الكويتي له حق التعويض فقط عن أية خسائر مُطالب بها تكون غير مزدوجة.

At the same time, the non-Kuwaiti claimant has filed a separate claim for the same business on the basis that the Kuwaiti claimant had rented the business licence to the non-Kuwaiti claimant for a monthly or annual fee and the non-Kuwaiti claimant was in fact the sole owner of the business.
