48. The right to equal treatment before tribunals and other organs administering justice is a constitutionally recognized right in Ethiopia.
48- إن حق المساواة في المعاملة أمام المحاكم أو غيرها من أجهزة إقامة العدل حق معترف به دستورياً في إثيوبيا.

In its reporting guidelines, it requires States to report on measures taken to ensure the right to equal treatment before tribunals and other organs administering justice and the right to security of person, in particular in connection with arrest and detention (CERD/C/2007/1).
وتقتضي اللجنة في توجيهاتها المتعلقة بتقديم التقارير أن تقوم الدول بالإبلاغ عن التدابير المتخذة لكفالة حق المساواة في المعاملة أمام المحاكم وغيرها من أجهزة إقامة العدل والحق في الأمن الشخصي، ولا سيما فيما يتعلق بالاعتقال والاحتجاز (CERD/C/2007/1).

22. CERD recommended that the State guarantee the right of everyone to equal treatment before tribunals and all other organs administering justice.
22- وأوصت لجنة القضاء على التمييز العنصري بأن تضمن الدولة حق كل فرد في المساواة في المعاملة أمام المحاكم وسائر الهيئات المكلفة بإقامة العدل(52).

(c) As the Committee stated in its General recommendation XX, " many of the rights and freedoms mentioned in article 5, such as the right to equal treatment before tribunals, are to be enjoyed by all persons living in a given State " , thereby confirming the impossibility to deny protection on the basis of territorial jurisdiction.
(ج) حسبما أشارت اللجنة في توصيتها العامة العشرين " يتمتع جميع الأشخاص المقيمين في دولة ما بالعديد من الحقوق والحريات المشار إليها في المادة 5، مثل الحق في المساواة في المعاملة أمام المحاكم " ()، مما يؤكد بالتالي استحالة رفض الحماية على أسـاس الولاية الإقليمية.

(c) As the Committee stated in its general recommendation No. 20, " many of the rights and freedoms mentioned in article 5, such as the right to equal treatment before tribunals, are to be enjoyed by all persons living in a given State " , thereby confirming the impossibility to deny protection on the basis of territorial jurisdiction;

Both regular and irregular migrants should therefore enjoy, inter alia, freedom of expression or association; freedom from racial discrimination in the areas of education or health; the right to equal treatment before the tribunals and all other organs administering justice; and a guarantee of their physical integrity by the State concerned.
