The Act stipulates that " in the absence of an extradition treaty or relevant legislative provisions, extradition shall be carried out according to the procedure and in compliance with the principles defined by the Model Treaty on Extradition adopted by the General Assembly of the United Nations in its resolution 45/116.

One country, while not having a minimum penalty requirement in its legislation, relied on the Model Treaty on Extradition (General Assembly resolution 45/116, annex), which left it to the discretion of States to use a one- or two-year minimum penalty threshold; however, that country had not yet taken a decision on whether one or two years should be applied.

Treaties such as the Organized Crime Convention (articles 13 and 16-18) and the Convention against Corruption (articles 44-46) have provisions on extradition, transfer of sentenced persons and mutual legal assistance that closely reflect many of the approaches of the Model Treaty on Extradition (resolutions 45/116 and 52/88) and the Model Treaty on Mutual Assistance in Criminal Matters.

The principles enshrined in the Model Treaty on Extradition and the Model Treaty on Mutual Assistance in Criminal Matters have facilitated international consensus in developing binding provisions on those issues in the Organized Crime Convention (arts. 16 and 18) and the United Nations Convention against Corruption (Assembly resolution 58/4, annex) (arts. 44 and 46).
17- وقد سهّلت المبادئ الراسخة في المعاهدة النموذجية لتسليم المجرمين والمعاهدة النموذجية لتبادل المساعدة في المسائل الجنائية توافق الآراء دوليا بشأن وضع أحكام ملزمة تتعلق بتلك القضايا في اتفاقية الجريمة المنظمة (المادتان 16 و18) واتفاقية الأمم المتحدة لمكافحة الفساد (قرار الجمعية العامة 58/4، المرفق) (المادتان 44 و46).

37. UNODC, with its extensive substantive expertise in international cooperation, has the ability to assist States in developing treaty relations at the various levels, in particular on the basis of the revised manuals on the Model Treaty on Extradition (General Assembly resolutions 45/116, annex, and 52/88, annex) and on the Model Treaty on Mutual Assistance in Criminal Matters (resolution 45/117, annex).
