It would doubtless be prudent to consider that a statement concerning implementation of the treaty at the internal level is strictly informative if it does not, as such, purport to affect the rights and obligations of the State formulating the statement vis-à-vis the contracting parties and, in addition, is not likely to have such an effect.
ولا شك في أن الحذر يقتضي اعتبار الإعلان المتعلق بتنفيذ المعاهدة على الصعيد الداخلي مجرد إعلان إعلامي إذا لم يكن يستهدف في حد ذاته التأثير على ما يترتب على الدولة التي تصوغه من حقوق والتزامات إزاء الأطراف المتعاقدة، وإذا لم يكن من شأنه، في نفس الوقت، أن يمارس مثل هذا التأثير.

A statement made by a State concerning its implementation of a treaty at the internal level can constitute a genuine reservation even if the desire to modify or exclude the legal effect of certain provisions of the treaty or of the treaty as a whole with respect to certain specific aspects as they apply to that State is not immediately clear.
فالإعلان الذي تصدره دولة ما بشأن تنفيذ المعاهدة على الصعيد الداخلي يمكن أن يكون تحفظا حقيقا حتى ولو لم تظهر بصورة فورية إرادة تعديل أو استبعاد الأثر القانوني لأحكام معينة من المعاهدة أو للمعاهدة ككل فيما يتعلق ببعض الجوانب المحددة عند تطبيق هذه الأحكام على تلك الدولة.

55. With regard to guideline 1.4.5, “Statements concerning modalities of implementation of a treaty at the internal level”, the phrase “without purporting as such to affect its rights and obligations towards the other contracting parties” was used in place of the wording in the previous version “but which does not affect its rights and obligations towards the other contracting parties”.
55 - وفيما يتعلق بالمبدأ التوجيهي 1-4-5 المعنون " الإعلانات المتعلقة بطرائق تنفيذ المعاهدة على الصعيد الداخلي " ، فإن عبارة " دون أن يكون هدف الإعلان، بوصفه هذا، المساس بحقوق الأطراف المتعاقدة الأخرى وبالتزاماتها " قد استعيض بها عن التعبير المستعمل في الصيغة السابقة، أي عبارة " غير أنها لا تؤثر على حقوقها والتزاماتها تجاه الأطراف المتعاقدة الأخرى " .

Moreover, the new formulation avoided any confusion with declarations relating to the implementation of the treaty at the internal level or with general statements of policy which were the object of other draft guidelines.
والصيغة الجديدة تتجنب أيضا إمكانية الخلط مع الإعلانات المتعلقة بتطبيق المعاهدة على الصعيد الداخلي أو معاهدات السياسة العامة، التي هي موضوع مشاريع مبادئ توجيهية أخرى.

(9) Accordingly, it would appear that declarations which simply give indications of the manner in which the State that formulates them will implement the treaty at the internal level are not interpretative declarations, even though they bear a definite relationship to the treaty.
9) وعليه يبدو أن الإعلانات التي تكتفي بالدلالة على الطريقة التي تعتزم الدولة التي تصدرها أن تنفذ بها المعاهدة على الصعيد الداخلي ليست إعلانات تفسيرية رغم أنها، خلافاً للإعلانات، لها صلة مؤكدة بالمعاهدة.

(9) Accordingly, it would appear that declarations which simply give indications of the manner in which the State which formulates them will implement the treaty at the internal level are not interpretative declarations, even though, unlike the declarations covered by draft guideline 1.4.4 [1.2.5], they are directly linked to the treaty.
9) وعليه يبدو أن الإعلانات التي تكتفي بالدلالة على الطريقة التي تعتزم الدولة التي تصدرها أن تنفذ بها المعاهدة على الصعيد الداخلي ليست إعلانات تفسيرية رغم أنها، خلافا للإعلانات المقصودة في مشروع المبدأ التوجيهي 1-4-4 [1-2-5]، لها صلة مباشرة بالمعاهدة.
