ما لم تنص المعاهدة على حكم مخالف أو ما لم تكن الممارسة المعتادة التي تتبعها الجهة الوديعة مختلفة، لا يعتبر صوغ تحفظ متأخر مقبولا إلا إذا لم تعارض أي دولة متعاقدة أو منظمة متعاقدة أخرى هذا الصوغ بعد انقضاء مهلة الاثني عشر شهرا التي تلي تلقيها الإشعار بالتحفظ.
