22. Regarding the Committee's concern, expressed in paragraph 19 of the concluding observations, about nationality, article 18 of the Iraqi Constitution addresses the subject of the acquisition of nationality. It stipulates:

واختتم قائلا إنه يشاطر التفاهم المعبر عنه في الفقرة ١٣٠ من الوثيقة A/52/33 بأنه لن يكون للتوصية أية آثار تترتب على أية تغييرات في ميثاق اﻷمم المتحدة أو القانون اﻷساسي للمحكمة.

16.Regarding the Committee's concern, expressed in paragraph 13 of the concluding observations on the previous report, regarding allocation of budgetary resources in favour of children, the issue is addressed in paragraph 69 of this report.

25. Regarding the Committee's concern, expressed in paragraph 21 of the concluding observations, relating to ill-treatment and sexual abuse, Iraqi law addresses these matters on the basis of the following:
25- وبشأن قلق اللجنة المعبر عنه في الفقرة 21 من الملاحظات الختامية فيما يتعلق بسوء المعاملة والإساءة الجنسية نود بيان أن القوانين العراقية قد عالجت هذه الأمور من خلال الآتي:

17. The Advisory Committee shares the concern expressed in paragraph 28 of the report that as some of the large missions close, the Organization may be placed in a situation where it must arrange for storage and maintenance of a far larger quantity of assets than may reasonably be required to support ongoing or future missions.
١٧ - وتشاطر اللجنة الاستشارية القلق المعبر عنه في الفقرة ٢٨ من التقرير من أنه بينما تنتهي بعض البعثات الكبيرة، قد تجد المنظمة نفسها في وضع يحتم عليها أن تنظم لتخزين وصون كمية من الموجودات أكبر بكثير مما قد يطلب منها بصورة معقولة لدعم البعثات الجارية أو البعثات المقبلة.

9. Regarding the Committee's concern, expressed in paragraph 6 of the concluding observations, regarding the Republic of Iraq's reservation to article 14, paragraph 1, of the Convention, we would like to affirm our reservation to the said article on the grounds of its incompatibility with the principles of the Islamic religion.
9- بشأن قلق اللجنة المعبر عنه في الفقرة 6 من الملاحظات الختامية إزاء تحفظ جمهورية العراق على المادة 14، الفقرة 1، من الاتفاقية نود بيان تأكيدنا على تحفظنا على هذه المادة لتعارضها مع مبادئ الدين الإسلامي الحنيف.

19. The Committee's concern expressed in paragraph 16 of the concluding observations has been answered in Section III (General principles).
19- وحول قلق اللجنة المعبر عنه في الفقرة 16 من الملاحظات الختامية فقد تمت الإجابة عن هذه الفقرة في إطار (الفصل الثالث- مبادئ عامة).

28. Regarding the Committee's concern, expressed in paragraph 23 of the concluding observations, relating to adolescent health and the data on teenage pregnancy, abortion and suicide, Public Health Act No. 89 (1981) makes reference to mother and child welfare and family health and to the duty of society and the State towards mother and child from conception.
28- وبشأن قلق اللجنة المعبر عنه في الفقرة 23 من الملاحظات الختامية فيما يتعلق بصحة المراهقين وبيانات الحمل والإجهاض والانتحار فقد أشار قانون الصحة العامة رقم 89 لسنة 1981 إلى رعاية الأمومة والطفولة وصحة الأسرة إلى تحقيق واجب المجتمع والدولة تجاه الأم والطفل منذ تكوينه جنينا.

18. The United Kingdom Government shares the view expressed in paragraph (2) of the commentary that the approach set out in alternative A (the " opting-in " approach) best reflects the consensual basis of the court's jurisdiction.
١٨ - تؤيد حكومة المملكة المتحدة الرأي المعبر عنه في الفقرة )٢( من التعليق، ومفاده اعتبار النهج الوارد بيانه في البديل ألف )نهج " الاختيار " ( يعكس على خير وجه أساس التوافق في اﻵراء الذي يستند إليه اختصاص المحكمة.

29. Regarding the Committee's concern, expressed in paragraph 24 of the concluding observations, about the lack of facilities and services for persons with disabilities, article 32 of the Iraqi Constitution stipulates that: The State shall care for the handicapped and those with special needs and ensure their rehabilitation in order to reintegrate them into society. This shall be regulated by law.
29- وبشأن قلق اللجنة المعبر عنه في الفقرة 24 من الملاحظات الختامية فيما يتعلق بعدم توفر المرافق والخدمات للأشخاص المعاقين فقد نص الدستور العراقي في المادة 32 على ما يأتي: (ترعى الدولة المعاقين وذوي الاحتياجات الخاصة وتكفل تأهيلهم بغية دمجهم في المجتمع وينظم ذلك بقانون).

37. Regarding the Committee's concern, expressed in paragraph 29 of the concluding observations, relating to juvenile justice and its incompatibility with the Convention, we note that article 19 (first) of the Iraqi Constitution stipulates that: The judiciary is independent and has no power over it save the law.
37- وبشأن قلق اللجنة المعبر عنه في الفقرة 29 من الملاحظات الختامية فيما يتعلق بقضاء الأحداث وعدم انسجامه مع الاتفاقية نود أن نبين أن الدستور العراقي نص في المادة 19/أولاً على (القضاء مستقل لا سلطان عليه لغير القانون).

In keeping with the expectations of the Security Council on the issue, as expressed in paragraph 12 (b) of resolution 1230 (1999), and as follow-up to President Patassé's undertakings, my Special Representative is continuing to press for FORSDIR to be confined to its legitimate duties.
ووفقا لتوقعات مجلس الأمن في هذه المسألة، على النحو المعبر عنه في الفقرة 12 (ب) من القرار 1230 (1999)، وفي إطار متابعة الالتزامات التي تعهد بها الرئيس باتاسي، يواصل ممثلي الخاص الضغط من أجل إلزام الحرس الجمهوري حدود واجباته المشروعة.

20. Regarding the Committee's concern, expressed in paragraph 17 of the concluding observations, that existing welfare policies and prevailing practices do not adequately reflect a rights-based approach, we note that there are draft laws pending enactment in this area, such as the draft Iraqi Children's Act, the Children's Parliament Act, the Child Welfare Commission Act and the Orphans' Welfare Fund Act.
20- وبشأن قلق اللجنة المعبر عنه في الفقرة 17 من الملاحظات الختامية فيما يتعلق بكون السياسات القائمة والممارسات السائدة في مجال الرعاية لا تعكس النهج القائم على الحقوق فان هناك مشاريع قوانين في هذا المجال مثل مشروع قانون الطفل العراقي وقانون برلمان الطفل وقانون هيئة رعاية الطفولة وقانون صندوق رعاية الأيتام (قيد التشريع).

21. Regarding the Committee's concern, expressed in paragraph 18 of the concluding observations, about the participatory rights of children, encouraging children to take an active role in promoting the Convention, and the role of non-governmental organizations, article 38 of the Iraqi Constitution stipulates that, as long as public order and public morality are not violated, the State guarantees the freedom to express opinion by any means.
21- وحول قلق اللجنة المعبر عنه في الفقرة 18 من الملاحظات الختامية فيما يتعلق بحقوق الطفل في المشاركة وتشجيع الأطفال على القيام بدور نشط في الترويج للاتفاقية ودور المنظمات غير الحكومية فإن الدستور العراقي نص في المادة 38 على (تكفل الدولة بما لا يخل بالنظام العام والآداب العامة حرية التعبير عن الرأي بكل الوسائل).

24. Regarding the Committee's concern, expressed in paragraph 20 of the concluding observations, about torture and corporal punishment, we would like to clarify that article 29 (fourth) of the Iraqi Constitution forbids violence, stipulating that all forms of violence and arbitrary behaviour in the family, school and society are prohibited. Furthermore, pursuant to Act No. 30 (2008), Iraq has acceded to the Convention against Torture.
24- وبشأن قلق اللجنة المعبر عنه في الفقرة 20 من الملاحظات الختامية فيما يتعلق بالتعذيب وحظر العقوبة البدنية نود أن نبين بأن الدستور العراقي قد منع العنف في المادة (29 رابعاً) والتي تنص على (تمنع كل أشكال العنف والتعسف في الأسرة والمدرسة والمجتمع) كما أن العراق قد انضم إلى اتفاقية مناهضة التعذيب وفق قانون رقم 30 لسنة 2008.

33. Regarding the Committee's concern, expressed in paragraph 26 of the concluding observations, about growing economic exploitation of children, we note that article 29 (third) of the Iraqi Constitution stipulates that: Economic exploitation of children in all forms shall be prohibited and the State shall take the necessary measures for their protection.
33- وحول قلق اللجنة المعبر عنه في الفقرة 26 من الملاحظات الختامية فيما يتعلق بازدياد الاستغلال الاقتصادي للأطفال نود أن نبين بان الدستور العراقي قد حظر الاستغلال الاقتصادي للأطفال في المادة (29 ثالثاً) والتي تنص على (يحظر الاستغلال الاقتصادي للأطفال بصوره كافة، وتتخذ الدولة الإجراءات الكفيلة بحمايتهم).

36. Regarding the Committee's concern, expressed in paragraph 28, about the threat posed by landmines to the survival and development of children, we note Iraq's accession to the Convention on the Prohibition of the Use, Stockpiling, Production and Transfer of Anti-Personnel Mines and on their Destruction, signed in Ottawa on 2 December 1997, and promulgation of the act of accession (Act No. 11, 2006).
36- وحول قلق اللجنة المعبر عنه في الفقرة 28 من الملاحظات الختامية فيما يتعلق بالألغام ومخاطرها على بقاء الأطفال وتطورهم نود أن نبين انضمام العراق إلى اتفاقية حظر استعمال وتخزين وإنتاج ونقل الألغام المضادة للأفراد وتدمير تلك الألغام الموقعة في أوتاوا بتاريخ 2 كانون الأول/ديسمبر 1997 وإصدار قانون الانضمام لها رقم (11) لسنة 2006.

13. Recalls section IV, paragraph 1, of its resolution 56/242, in which it requested the Secretary-General not to conduct further pilot projects on remote interpretation until technological developments so warrant, and in this regard requests the Secretary-General to take into consideration the experiences of international institutions and organizations in this area, as expressed in paragraph 102 of the report of the Secretary-General;
