IV. BACKGROUND TO THE ESTABLISHMENT OF THE COMMITTEE on Applications
رابعا - خلفية إنشاء اللجنة المعنية بالطلبات

Since the adoption of the article in 1955, the Committee on Applications had referred only three cases to the International Court of Justice and on each occasion the Court had upheld the judgement of the Administrative Tribunal.

بيد أن إلغاء اللجنة المعنية بالطلبات قد ينبغي أن يصحب بالنظر في أمر إيجاد آلية جديدة لحل المشاكل المتعلقة بعمل الموظفين، آلية مثل منصب أمين المظالم لا تكون لها صلة مباشرة بالمحكمة اﻹدارية ولا تحتل مركزا أرفع منها بأي حال من اﻷحوال.

Moreover, owing to the political composition of the Committee on Applications, its votes were explainable more in terms of geographic solidarity than of legal logic, and the cumulative delays in examining cases made requesting advisory opinions less desirable and rendered their application problematic.
