Mr. SLADE (Samoa), Coordinator for Part 13, said that that Part contained the final clauses.

The CHAIRMAN invited the Coordinator for Part 3 to introduce the report of the Working Group on General Principles of Criminal Law (A/CONF.183/C.1/WGGP/L.4/Add.1/Rev.1).
١ - الرئيس : دعا المنسق المعني بالباب ٣ إلى عرض تقرير الفريق العامل المعني بالمبادئ العامة للقانون الجنائي )A/CONF.183/C.1/WGGP/L.4/Add.1/Rev.1( .

The CHAIRMAN recalled that, at the previous meeting, the Coordinator for Part 3 had proposed that articles 24 and 29 should be referred to the Drafting Committee, after a brief discussion if necessary.
٧٥ - الرئيس : أعاد إلى اﻷذهان أن المنسﱢق المعني بالباب ٣ قد اقترح في الجلسة السابقة أن تحال المادتان ٢٤ و ٢٩ إلى لجنة الصياغة ، بعد مناقشة موجزة إذا دعت الضرورة .

Mr. SALAND (Sweden), Coordinator for Part 3 and Chairman of the Working Group on General Principles of Criminal Law, said that he would have no objection to the correction suggested by New Zealand.

The CHAIRMAN invited the Coordinator for Part 3 and Chairman of the Working Group on General Principles of Criminal Law to introduce the Group’s report (A/CONF.183/C.1/WGGP/L.4).
٣٧ - الرئيس : دعا المنسق المعني بالباب ٣ ورئيس الفريق العامل المعني بالمبادئ العامة للقانون الجنائي بعرض تقرير الفريق (A/CONF.183/C.1/WGGP/L.4) .

The CHAIRMAN invited the Coordinator for Part 4 to introduce “cluster 2”: article 38; article 39, paragraphs 3 (b) and 4; articles 42 to 44; article 45, paragraph 4; and articles 47, 49, 52 and 53.
٦٤ - الرئيس : دعا المنسق المعني بالباب ٤ الى عرض " المجموعة ٢ " : المادة ٨٣ ؛ المادة ٩٣ ، الفقرتان ٣ )ب( و ٤ ؛ المواد ٢٤ الى ٤٤ ؛ المادة ٥٤ ، الفقرة ٤ ؛ والمواد ٧٤ و ٩٤ و ٢٥ و ٣٥ .

Mr. RWELAMIRA (South Africa), Coordinator for Part 4, said that there did not seem to be any major problems with paragraph 1 of article 38.

Mr. SALAND (Sweden), Coordinator for Part 3, said that as he had already explained, paragraph 1 (c) of article 31 was still pending, which meant that for the present the footnotes relating to it were deleted.

Mr. RAMA RAO (India), Coordinator for Part 11, introducing his report (A/CONF.183/C.1/L.47), said that it concerned only one article, article 102.
١٩ - السيد راما راو )الهند( ، المنسق المعني بالباب ١١ ، عرض تقريره (A/CONF.183/C.1/L.47) وقال إن التقرير معني بمادة واحدة فقط ، هي المادة ١٠٢ .

Mr. SALAND (Sweden), Coordinator for Part 3, introducing article 26 on the age of responsibility, said that the issue was complicated by the fact that the age of responsibility varied a great deal from one country to another.
٣ - السيد سالاند )السويد( : المنسق المعني بالباب ٣ ، قال في عرضه المادة ٢٦ بشأن سن المسؤولية أن المسألة معقدة بسبب اختلاف سن المسؤولية اختلافا كبيرا من بلد ﻵخر .

Mr. SALAND (Sweden), Coordinator for Part 3, introducing article 27 (“Statute of limitations”), drew attention to the many different proposals contained in the Preparatory Committee’s draft.
٤٥ - السيد سالاند )السويد( ، المنسق المعني بالباب ٣ : لفت الانتباه ، في عرضه للمادة ٢٧ ) " قانون التقادم المسقط " ( ، إلى كثير من المقترحات المختلفة الواردة في مشروع اللجنة التحضيرية .

Mr. van der WIND (Netherlands), acting as Coordinator for Part 2, said that discussions in the past had focused on the question of the selection of the crimes to be included within the Court’s jurisdiction and on their definition.
٢ - السيد فان دير فيند )هولندا( : تكلم بصفته المنسق المعني بالباب ٢ ، فقال ان المناقشات ركزت في الماضي على مسألة اختيار الجرائم التي يتعين أن تدرج في اختصاص المحكمة ، وعلى تعريف الجرائم .

Mr. BASSIOUNI (Egypt), Chairman of the Drafting Committee, said that the Committee of the Whole had recently approved document A/CONF.183/C.1/L.78, containing the recommendations of the Coordinator for Part 12.
٦٢ - السيد بسيوني )مصر( ، رئيس لجنة الصياغة : قال ان اللجنة الجامعة كانت قد وافقت مؤخرا على الوثيقة A/CONF.183/C.1/L.78 ، التي تتضمن توصيات المنسق المعني بالباب ٢١ .

Mr. RWELAMIRA (South Africa), Coordinator for Part 4, said he thought that some of the articles in Part 4 of the draft text in document A/CONF.183/2/Add.1 were already at a stage where they could be referred to the Drafting Committee without debate or with very little debate in the Committee of the Whole.

Mr. MOCHOCHOKO (Lesotho), Coordinator for Part 9, introducing the report of the Working Group, said it was transmitting to the Committee for consideration article 85, article 86, paragraphs 1 to 4 and 6 to 7, articles 88, 89 and 90 bis, all paragraphs in article 91 with the exception of paragraph 4, and article 91 bis.
٢ - السيد موشوشوكو )ليسوتو( ، المنسق المعني بالباب ٩ : قال في معرض تقديمه لتقرير الفريق العامل إنه يحيل إلى اللجنة المواد التالية للنظر فيها : المادة ٨٥ و المـادة ٨٦ ، الفقـرات ١ - ٤ و ٦ و ٧ ، والمواد ٨٨ و ٨٩ و ٩٠ مكررا وجميع فقرات المادة ٩١ باستثناء الفقرة ٤ ، والمادة ٩١ مكررا .

Mr. SALAND (Sweden), Coordinator for Part 3, introducing the report, said that the entire text of subparagraph (c) of article 31, paragraph 1, should be deleted and replaced with the word “pending”, and that in consequence footnotes 9, 10 and 11 should also be deleted.
٢ - السيد سالاند )السويد( ، المنسق المعني بالباب ٣ : قال أثناء عرضه التقرير أنه يجب حذف نص الفقرة الفرعية )ج( بكاملها من الفقرة ١ بالمادة ٣١ ، والاستعاضة عنها بعبارة " قيد النظر " ، وأضاف أنه بالتالي يجب حذف الحواشي ٩ و ١٠ و ١١ .

Mr. SALAND (Sweden), Coordinator for Part 3, said that he had proposed replacing the words “act [or omission]” in paragraph 2 (a) of article 29 by the word “conduct” and deleting paragraph 4 of that article.
٧٦ - السيد سالاند )السويد( ، المنسﱢق المعني بالباب ٣ : قال إنه اقترح الاستعاضة عن عبارة " ارتكاب الفعل ]أو الامتناع[ " الواردة في الفقرة ٢ )أ( في المادة ٢٩ بعبارة " ارتكاب السلوك " ، واقترح حذف الفقرة ٤ من هذه المادة .

The CHAIRMAN recalled that Part 1 had been introduced by the Coordinator of Part 1, Mr. Rama Rao (India), at the previous meeting.
