There was a general agreement that the key issue for the application of a legal standard on transparency to future investment treaties was that of consent.

It was further said that such an approach would create confusion and legal uncertainty and that the Working Group should rather focus on drafting an instrument to be adopted by States aimed at ensuring that the legal standard on transparency would apply to existing investment treaties.
وقيل أيضا إنَّ هذا النهج سوف يخلق بلبلة وعدم يقين قانوني وإنَّ الأحرى بالفريق العامل أن يركّز على صوغ صك تعتمده الدول بهدف ضمان انطباق المعيار القانوني الخاص بالشفافية على معاهدات الاستثمار القائمة.

Such new convention, however, would make the legal standard on transparency applicable only to investment treaties between such States parties that were also parties to the new convention.
ومن شأن اتفاقية جديدة من هذا القبيل أن تجعل المعيار القانوني الخاص بالشفافية لا ينطبق إلا على معاهدات الاستثمار المبرمة بين الدول الأطراف التي هي أطراف أيضا في الاتفاقية الجديدة.

1. Option for the investor to refuse the legal standard on transparency
1- تمكين المستثمر من اختيار رفض المعيار القانوني الخاص بالشفافية

It was pointed out that the legal standard on transparency was not meant to benefit only the investor and the host State but also civil society, so it was not for the investor alone to decide on such matters.
وأشير إلى أنَّ المقصود من المعيار القانوني الخاص بالشفافية هو أن يعود بالنفع لا على المستثمر والدولة المضيفة وحدهما، بل على المجتمع المدني أيضا، فليس للمستثمر وحده أن يبتّ في هذه المسائل.

Depending on whether the legal standard on transparency would contain an opt-in or opt-out mechanism, it would be up to the State to formulate the offer it wished to make to the investor.
وتبعا لمدى تضمّن المعيار القانوني الخاص بالشفافية لآلية تتيح اختيار الانطباق أو اختيار عدم الانطباق، يترك للدولة أمر صوغ العرض الذي تود تقديمه للمستثمر.

2. Agreement to depart from the legal standard on transparency after the dispute had arisen
2- الاتفاق على الخروج عن المعيار القانوني الخاص بالشفافية بعد نشأة المنازعة

It was also said that the expectations of third parties who stood to benefit from the legal standard on transparency had to be taken into due consideration.
وقيل أيضا إنه لا بدّ من أن يُولى الاعتبار الواجب لتطلّعات الأطراف الثالثة التي تستفيد من المعيار القانوني الخاص بالشفافية.

In addition, the legal standard on transparency was meant to benefit not only the investor and the host State but also the general public, with the consequence that it was not for the disputing parties to renounce transparency provisions adopted by the States.
وقيل أيضاً إنَّ القصد من المعيار القانوني الخاص بالشفافية هو ألاَّ يعود بالنفع على المستثمر والدولة المضيفة وحدهما، بل على الجمهور العام أيضا، ومن ثم فليس من شأن الطرفين المتنازعين أن يتخليا عن أحكام الشفافية التي تعتمدها الدول.
