The Committee considers that, in the circumstances of the case, the limitations imposed on the author, although based on domestic law, were not justified pursuant to the conditions set out in article 19, paragraph 3, of the Covenant.

In light of this, the Committee considered that the sanction of imprisonment imposed on the author was incompatible with article 19, paragraph 3, of the Covenant.
وبناءً على ما تقدم، رأت اللجنة أن عقوبة السجن المفروضة على صاحب البلاغ في هذه القضية تتعارض والفقرة 3 من المادة 19 من العهد.

It reduced the sentence imposed on the author from 12 to 11 years' imprisonment, excluding from the consideration of aggravating circumstances the fact that the author had been intoxicated at the time of the offence.

4.6 As to the case under consideration, the penalty imposed on the author is not the consequence of any infringement of traffic regulations, but is the consequence of the offence committed by the owner of the vehicle visàvis the duty to cooperate required by law of any vehicle owner.
4-6 أما في الحالة قيد النظر، فإن العقوبة المفروضة على صاحب البلاغ لم تأت نتيجة لأي مخالفة لقانون المرور وإنما نتيجة لإخلال مالك السيارة بواجب التعاون الذي ينص عليه القانون بالنسبة لمالك أي سيارة.

An employer's failure to comply with this obligation is without prejudice to the validity of legal actions taken in this way, however, it constitutes a violation of labour regulations which can be sanctioned with a fine of up to SK 500,000; in the case of repeated violation of this obligation the fine imposed on the employer can be as high as SK 1 million.
وعدم امتثال صاحب العمل لهذا الالتزام لا يخل بصلاحية الدعاوى القانونية التي ترفع بسبب ذلك ولكنه يشكل انتهاكاً لقوانين العمل ويمكن معاقبته بغرامة تصل إلى 500000 كورونا سلوفاكية، وقد ترتفع الغرامة المفروضة على صاحب العمل إلى مليون كورونا في حال الانتهاك المتكرر لهذا الالتزام.

7.10 In light of the above, the Committee considers that, in the present case the sanction of imprisonment imposed on the author was incompatible with article 19, paragraph 3, of the Covenant.
7-10 وبناءً على ما تقدم، ترى اللجنة أن عقوبة السجن المفروضة على صاحب البلاغ في هذه القضية تتعارض والفقرة 3 من المادة 19 من العهد.

The Committee examined these arguments and considered that the information before it did not permit it to verify whether the restrictions imposed on the author, as an independent candidate, in federal parliamentary elections through the requirements of the electoral system in place at the time, were in compliance with the provisions contained in article 25 of the Covenant.

10-7 وترى اللجنة أن المعلومات المتاحة لها لا تسمح بالتأكد مما إذا كانت القيود المفروضة على صاحب البلاغ، بصفته مرشحا مستقلا، لخوض الانتخابات البرلمانية الاتحادية والمتمثلة في شروط النظام الانتخابي القائم حينها تتوافق مع الأحكام المنصوص عليها في المادة 25 من العهد.

2.8 On 29 May 2009, the Asylum Sector of the Ministry of Security extended for a period of 90 days, as of 4 June 2009, the measures imposed on the author with regard to restriction of movement and the prohibition on leaving the facilities of the immigration centre in Sarajevo.
