Mohammed El-Megreisi was asked to dress and accompany them, purportedly to assist in some unspecified security matter.

2.3 In April 1992, the El-Megreisi family learned that he was still alive, since he was allowed a visit by his wife.
٢-٣ وفي نيسان/ابريل ١٩٩٢، علمت أسرة المقريسي بأنه لا يزال على قيد الحياة، نظرا ﻷنه سمح لزوجته بزيارته.

5.3 The Committee therefore bases its assessment on the undisputed facts that Mr. Mohammed El-Megreisi was arrested in January 1989, that no charges were or have been brought against him and that he has not been released to date.

Having regard to these facts, the Committee finds that Mr. Mohammed Bashir El-Megreisi, by being subjected to prolonged incommunicado detention in an unknown location, is the victim of torture and cruel and inhuman treatment, in violation of articles 7 and 10, paragraph 1, of the Covenant.
وتجد اللجنة، بعد أن نظرت في هذه الوقائع، أن السيد محمد المقريسي بتعرضه للاحتجاز المديد في السجن الانفرادي في مكان غير معلوم، يعتبر ضحية للتعذيب وللمعاملة القاسية واللاإنسانية، انتهاكا للمادة ٧ والفقرة ١ من المادة ١٠ من العهد.

Having concluded its consideration of communication No. 440/1990, submitted to the Human Rights Committee by Mr. Youssef El-Megreisi on behalf of his brother, Mr. Mohammed Bashir El-Megreisi, under the Optional Protocol to the International Covenant on Civil and Political Rights,
وبعد أن اختتمت نظرها في البلاغ رقم ٤٤٠/١٩٩٠، المقدم إلى اللجنة المعنية بحقوق اﻹنسان من السيد يوسف المقريسي بالنيابة عن شقيقه، محمد بشير المقريسي، بموجب البروتوكول الاختياري للعهد الدولي الخاص بالحقوق المدنية والسياسية،

5.4 Moreover, the Committee notes, from the information before it, that Mohammed El-Megreisi was detained incommunicado for more than three years, until April 1992, when he was allowed a visit by his wife, and that after that date he has again been detained incommunicado and in a secret location.
٥-٤ وعلاوة على ذلك، تلاحظ اللجنة من المعلومات المعروضة عليها أن محمد المقريسي قد احتجز في السجن الانفرادي لمدة تجاوزت ثلاث سنوات، حتى نيسان/ابريل ١٩٩٢، عندما سمح لزوجته بزيارته، وأنه احتجز بعد ذلك التاريخ في السجن الانفرادي في مكان سري.

67. Regarding communication 440/1990 (El-Megreisi v. Libyan Arab Jamahiriya) referred to in paragraphs 24 and 64 herein, in 2007, the HR Committee requested the Government to compensate the victim for the torture and cruel and inhuman treatment to which he had been subjected.
٦٧- فيما يخص البلاغ رقم ٤٤٠٧/١٩٩٠ (يوسف المقريسي ضد الجماهيرية)، المشار إليه في الفقرتين ٢٤ و٦٤ من هذه الوثيقة، طلبت اللجنة المعنية بحقوق الإنسان في عام ٢٠٠٧ من الحكومة تعويض ضحية التعذيب جراء المعاملة القاسية واللاإنسانية التي تعرض لها.

It is submitted that during his wife's visit, Mohammed El-Megreisi could not comment on the conditions under which he is detained, nor on whether he has been subjected to torture or to other cruel, inhuman or degrading treatment, out of fear of punishment, as meeting places are allegedly bugged and conversations between visitors and prisoners recorded.
وقيل في البلاغ إن محمد المقريسي لم يتمكن أثناء زيارة زوجته من التعليق على اﻷحوال التي يحتجز في ظلها ولا عما إذا كان تعرض للتعذيب أو غير ذلك من صور المعاملة القاسية أو اللاإنسانية أو المهينة، خوفا من العقوبة، نظرا لما يدعى بأن أماكن اللقاء مزودة بأجهزة تنصت ويجري تسجيل المحادثات التي تجري بين الزائرين والسجناء.

5.2 In spite of a reminder addressed to it in October 1993, the State party did not provide any information in respect of the substance of the author's allegations, nor in respect of Mr. M. El-Megreisi's current whereabouts, state of health and conditions of detention, as requested in paragraph 6 (c) of the Committee's decision on admissibility.
٥-٢ وبالرغم من توجيه رسالة تذكيرية إلى الدولة الطرف في تشرين اﻷول/اكتوبر ١٩٩٣، فإنها لم تقدم أي معلومات بصدد موضوع ادعاءات صاحب البلاغ، ولا بصدد مكان وجود السيد المقريسي حاليا، وحالته الصحية وظروف احتجازه، وهو المطلوب في الفقرة ٦ )ج( من مقرر اللجنة المتعلق بالمقبولية.

It urges the State party to take effective measures (a) to secure his immediate release; (b) to compensate Mr. Mohammed El-Megreisi for the torture and cruel and inhuman treatment to which he has been subjected; and (c) to ensure that similar violations do not occur in the future.
وهي تحث الدولة الطرف على اتخاذ التدابير الفعالة )أ( لكفالة إطلاق سراحه فورا؛ )ب( والتعويض على السيد محمد المقريسي مقابل التعذيب والمعاملة القاسية واللاإنسانية التي تعرض لها؛ )ج( وكفالة عدم حدوث انتهاكات مماثلة في المستقبل.
